BUSINESS MEETING
1. ROLL CALL -
The City Council met in session on this date at 2:00 P.M. in the
Council Chambers of City Hall, Yakima, Washington. Mayor Pat
Berndt, presiding, Council members Clarence Barnett, Henry
Beauchamp, Lynn Buchanan, George Pechtel, Skip Sewn and Bernard
Sims present on roll call. Assistant City Manager Stouder, City
Attorney Vanek, City Clerk Roberts and Clerk Givens also present.
2. INVOCATION /PLEDGE OF ALLEGIANCE

The Pledge of Allegiance was led by Council member Sims.
3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER
Mayor Berndt advised the Council that Jodi Wroblewski from the
Parks Department has resigned and accepted a position in Bremerton.
Dave Flaherty, Parks and Recreation Manager, announced that the
YMCA and the City solicited funds from the United Way to expand the
City's summer recreation programs (contracted to the YMCA to
administer). The additional $25,000 funding will expand the
programs at Martin Luther King Park, Miller Park, Gardner Park, and
Garfield Elementary School from four hours per day to six hours and
may extend the programs an additional two weeks.
Mr. Flaherty stated that the Parks and Recreation Commission met at
a special meeting last night to discuss Fisher Park Golf Course.
The Commission directed him to recommend that the Council do
absolutely nothing at this time. The Commission and staff feel
they are being misled about the number of balls actually hitting
the Rodvold's property; they feel it is not possible to satisfy the
Rodvolds. The Golf Course has been operating satisfactorily for 27
years with no serious problems.
Mayor Berndt commented there has been excellent rapport between the
Parks and Recreation, YMCA, United Way, the Housing Authority and
the Union Gospel Mission. There has been concerned, conscientious
effort to help the kids in the community.
4. CONSENT AGENDA
Mayor Berndt referred to the items placed on the Consent Agenda,
questioning whether there were any additions or deletions from
either Council members or citizens present. Items Nos. 10 and 11
were added to the Consent Agenda. Item No. 17 was removed by
citizen request. The City Clerk then read the Consent Agenda
items, including resolutions and ordinances by title. It was MOVED
BY SIMS, SECONDED BY BUCHANAN, THAT THE CONSENT AGENDA, AS READ, BE
PASSED. The motion carried by unanimous roll call vote.
(Subsequent paragraphs preceded by an asterisk ( *) indicate items
on the Consent Agenda handled under one motion without further
discussion).
*5. • APPROVAL OF THE MINUTES OF THE COUNCIL MEETINGS OF FEBRUARY 2, 5,
13 AND 15, 1990 AND APRIL 10, 1990
The Council minutes of February 2, 5, 13 and 15, 1990 and April 10,
1990 were approved, having been duly certified accurate by two
Council members and no one present wishing to have said minutes
read publicly. -

6. AUDIENCE PARTICIPATION
None
7. CONSIDERATION OF REPORT FROM DEPARTMENT OF COMMUNITY AND ECONOMIC
DEVELOPMENT REGARDING AMENDMENT TO TOWN OF UNION GAP AGREEMENT
PERTAINING TO SOUTH BROADWAY SEWER AND WATER SERVICE AREA
Glenn Rice, Director of Community & Economic Development, discussed
with the Council the memorandum concerning an amendment to the
Union Gap water and sewer service agreement. Union Gap Mayor, Ron
Krebs, asked the Council for assistance to meet the needs of the
people in the Union Gap area. Terry Ward, Union Gap Engineer .
Consultant, stated that Union Gap's water service problem is one of
delivery, because of a lack of water distribution lines. Following
Council discussion, it was the consensus of the Council that the .
delivery problem is Union Gap's and should not be taken on by the
City of Yakima; but rather annexation should be required when
Yakima water and sewer is requested. Larry Mathews, 801 S. 17th
Avenue, stated he feels if the homeowners want water service they
should be willing to annex; if not, then they shouldn't receive
service. It was MOVED BY SIMS, SECONDED BY BUCHANAN, TO DIRECT
STAFF TO PREPARE AMENDMENTS TO THE EXISTING CONTRACTS FOR THE CITY
OF YAKIMA RESUMING THE WATER/SEWER SERVICE SOUTH OF WASHINGTON
AVENUE, AT LEAST TO PIONEER LANE, AND ANNEXATION BE INITIATED
WITHIN THE AFFECTED NEIGHBORHOOD BY THE CITY OF YAKIMA. The motion
carried by unanimous voice vote.
8. CONSIDERATION OF REPORT FROM PARKS AND RECREATION DEPARTMENT
REGARDING TREE REPLACEMENT PROJECT AND FUNDING
Dave Flaherty, Parks & Recreation Manager, discussed care and
maintenance of existing trees and tree replacement. Council member
Pechtel questioned the purchase of a lift truck and asked for other
alternatives. Mr. Flaherty stated that to properly maintain the
mature trees they need the proper equipment. The maintenance and
operations costs were discussed by the Council, with a variety of
alternatives discussed. The consensus of the Council was that the
"urban forest" is a long term project. The Council is in favor of
maintaining the trees, but the problem is financing.
Paul Adams, 1306 S. 20th Avenue, a volunteer consultant on trees,
addressed the Council with the idea of trees being a resource not a
problem. He discussed the possibility of the City receiving grants
from the Department of Natural Resources to help with the "urban
forest ". He furnished the City with the information on tree
maintainance and urban forestry planning. He feels that proper
trees can be planted in the right areas of the City to best
compliment the area and not cause problems. It was MOVED BY
BUCHANAN, SECONDED BY BARNETT, TO DEFER THIS ISSUE UNTIL A FUTURE
DATE IN ORDER TO RECEIVE ADDITIONAL INFORMATION. The motion
carried by unanimous voice vote. Mr. Flaherty stated that a sub-
committee of the Parks and Recreation would be suggested to the
• Couu to organize a study of the "urban forest". Council
member Buchanan suggested a task force to look into this issue.
9. CONSIDERATION OF REPORT FROM CABLE TV AND FIRE DEPARTMENT REGARDING
WIRING FOR REMOTE CAMERA IN COUNCIL CHAMBERS
Wendy Warren, Yakima Community TV Programming Coordinator, spoke
to the Council concerning rearranging the Council Chambers and the
positioning of the cameras to better facilitate use of the TV
cameras with as little interference to the Council and audience as
possible. After further discussion by the Council regarding pros
and cons on the various possibilities, it was MOVED BY
SEMON, SECONDED BY BUCHANAN, TO MOVE FORWARD ON OPTION IW), BUT
KEEP THE CURRENT HORSESHOE CONFIGURATION AT THIS TIME. The motion
carried by a 5 -2 voice vote. Barnett and Pechtel voting nay.
(Option 2 includes three remote controlled cameras mounted
overhead. The output of the podium camera would still be available
to the TV reporters through video jacks in the rear wall. This

expanded option requires only one '`staff person to operate the
camera controls and video recorder).
* 10. PRESENTATION FROM PERSONNEL REGARDING 1989 AFFIRMATIVE
ACTION /CONTRACT COMPLIANCE ANNUAL REPORT
The report from Personnel regarding 1989 Affirmative
Action /Contract Compliance Annual Report, was accepted by being
placed on the Consent Agenda.
*11. PRESENTATION OF FIRE DEPARTMENT 1989 ANNUAL REPORT
The Fire Department 1989 Annual Report was accepted by being placed
on the Consent Agenda.
*12. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF GRANT
AGREEMENT WITH HUD FOR ACCEPTANCE OF URBAN DEVELOPMENT ACTION GRANT
FOR J. I. HAAS, INC. PROJECT
RESOLUTION NO. D -5732, A RESOLUTION authorizing execution of a
grant agreement with the United States Department of Housing and
Urban Development for the acceptance of an urban development action
grant in connection with the construction of a carbon dioxide hop
plant by John I. Haas, Inc. -
*13. CONSIDERATION OF RESOLUTIONS AUTHORIZING EXECUTION OF AGREEMENTS
WITH CHEN NORTHERN, INC. FOR ENVIRONMENTAL ASSESSMENTS:
A. CITY OWNED PARCEL
RESOLUTION N). D -5733, A RESOLUTION authorizing and directing -the
City Manager and City Clerk of the City of Yakima to enter into an
Agreement for services to perform an environmental assessment of
property owned by the City of Yakima.
B. PROPERTY CONSIDERED. FOR ACQUISITION
RESOLUTION NO. D -5734, A RESOLUTION authorizing the City Manager
and City Clerk of the City of Yakima to enter into an Agreement for
services to perform an environmental assessment of property located
in the City of Yakima.
* 14. CONSIDERATION OF RESOLUTIONS PERTAINING TO: THE TREE TOP BICYCLE
RACE:
A. RESOLUTION AUTHORIZING THE CLOSURE OF CERTAIN STREETS TO
ACCOMMODATE THE 1990 TREE TOP BICYCLE RACE '
RESOLUTION NO. D -5735, A RESOLUTION authorizing the closure of
certain streets within the City of Yakima to accommodate the "1990
• Tree Top Bicycle Classic ".
B. RESOLUTION AUTHORIZING EXECUTION OF MEMORANDUM OF UNDERSTANDING
RESOLUTION NO. D -5736, A RESOLUTION authorizing and directing the
City Manager of the City of Yakima to execute a Memorandum of
Understanding between the Tree Top Bicycle Race Committee and the
City of Yakima.
*15. CONSIDERATION OF RESOLUTION .AUTHORIZING EXECUTION OF PUBLIC WORKS
TRUST FUND LOAN AGREEMENT FOR TIETON DRIVE, 4TH - 16TH AVENUES
RESOLUTION NO. D -5737, A.RESOLUTION authorizing an agreement with
the Department of Community Development of the State of Washington,
for a loan for partial reimbursement of.costs for improvements to
Tieton Drive between 16th Avenue and 4th Avenue.

* 16. APPROVAL OF REPORTS FROM DEPARTMENT OF FINANCE AND BUDGET:
A. FIRST QUARTER 1990 BUDGET REPORT
The First Quarter 1990 Budget Report was accepted.
B. FIRST QUARTER 1990 TREASURY REPORTS (STANDARD MOTION VA; ACCEPT
REPORT)
The First Quarter 1990 Treasury Report was accepted.
17. CONSIDERATION OF AN ORDINANCE AMENDING THE UTILITY TAX
PROVISIONS OF THE MUNICIPAL CODE PROVIDING FOR PROCEDURAL AND
ADMINISTRATIVE CHANGES •
Larry Matthews, 807 S. 17th Avenue, asked about the net effect of
the changes on the utility tax provisions. City Attorney ,Vanek
answered that this Ordinance changes the audit and record keeping
function from the City Clerk to the Finance Director, and there is
a slight change in the definition of the tax to conform to the
State Law and a re- enactment of the ordinance putting into place
the State referendum instead of the City referendum procedure.
Ordinance No. 3263 having been read by title, it was MOVED BY
BUCHANAN, SECONDED BY SIMS, THAT THE ORDINANCE AS READ BE PASSED.
The motion carried by unanimous roll call vote.
ORDINANCE NO. 3263, AN ORDINANCE relating to licenses and business
regulations; establishing referendum procedures; assigning tax
audit and collection duties to the Director of Finance and Budget;
adding a new Section 5.50.205 to the City of Yakima Municipal Code;
repealing Section 5.50.100 of the City of Yakima Municipal Code and
amending Sections. 5.50.050, 5.50.090, 5.50.150, 5.50.160, 5.50.170
and 5.50.180 of the City of Yakima Municipal Code.
* 18. SECOND READING OF AN ORDINANCE APPROPRIATING FUNDS FOR PROPERTY
PROTECTION BARRIERS AT LINCOLN AND PIERCE AVENUES
An Ordinance appropriating funds for •property protection barriers
at Lincoln and Pierce Avenue, having been read by title only at the
previous meeting, was brought before the Council for a second
reading.
ORDINANCE NO. 3264, AN ORDINANCE amending the 1990 budget for the
City of Yakima; making an appropriation of $10,000 in the Arterial
.Street Fund for expenditure during 1990 for installation of
property protective barriers in the Lincoln /Pierce intersection
area.
* 19. FIRST READING OF AN ORDINANCE APPROPRIATING ADDITIONAL .FUNDING TO
REPOWER CITY PUMPER NO. 11 (NO FORMAL ACTION REQUIRED THIS
MEETING)
An Ordinance appropriating additional funding to repower City
Pumper No. 11, having been read by title only, was laid on the
table for two weeks, until May 8, 1990.
20. OTHER BUSINESS
It was MOVED BY PECHTEL, SECONDED BY SIMS, TO DIRECT STAFF TO BRING
BACK TO COUNCIL SOME ALTERNATIVES TO A JOINT CITY /COUNTY LAW
ENFORCEMENT FACILITY. The motion carried by unanimous voice vote.
It was MOVED BY,PECHTEL, SECONDED BY BUCHANAN, TO APPOINT COUNCIL
MEMBERS PECHTEL AND SEMON AND MAYOR BERNDT TO THE ECONOMIC
DEVELOPMENT COUNCIL COMMITTEE; COUNCIL MEMBER SIMS AS AN ALTERNATE.
The motion carried by unanimous voice vote.
It was MOVED BY PECHTEL, SECONDED BY SIMS, TO APPOINT AMELIA GARZA
OF GRANDVIEW TO FILL THE VACANCY AS THE SECOND CITY REPRESENTATIVE
ON THE DRUG COALITION COMMITTEE. The motion carried by unanimous
voice vote.

It was MOVED BY BUCHANAN, SECONDED BY SIMS, TO MOVE INTO EXECUTIVE
SESSION FOR THE PURPOSE OF DISCUSSING COLLECTIVE BARGAINING,
FOLLOWED BY IMMEDIATE ADJOURNMENT TO MAY 1, 1990 AT 12:.00 NOON FOR
A LUNCHEON MEETING. AT THE RED LION INN WITH THE PARKS AND
RECREATION COMMISSION. The motion carried by unanimous voice
vote.
22. ADJOURNMENT
. Following the executive session the meeting was adjourned at the
hour of 4:00 P.M. to May 1, 1990 at 12:00 Noon for a Luncheon
Meeting at the Red Lion Inn with the Parks and Recreation
Commission.
