STUDY SESSION
1. ROLL CALL
The City Council met in session on this date at 2:00 P.M. in the
Council Chambers of City Hall, Yakima, Washington. Mayor Pat Berndt,
presiding, Council members Clarence Barnett, Henry Beauchamp, Lynn
Buchanan, Skip Semon and Bernard Sims present on roll call. Council
member George Pechtel absent and excused. City Manager Zais,
Assistant City Attorney Jim Tree, City Clerk Roberts and Clerk Givens
also present.
2. INVOCATION /PLEDGE OF ALLEGIANCE
The Pledge of Allegiance was led by Council member Buchanan.

4. AUDIENCE PARTICIPATION
Linda Rodvold, 821 S. 38th Avenue, restated her complaints about
errant golf balls leaving Fisher Park Golf Course, posing a hazard for
her family and property. She monitored golf balls over the week -end,
and five balls landed in her yard between Saturday and Sunday. She
asked for a net to be installed immediately. She presented a petition
with 173 signatures, requesting action be taken to correct the problem
of errant golf balls at Fisher Park Golf Course. Dave Flaherty,
Manager of Parks and Recreation, reported on the monitoring of balls
leaving Fisher Park. He stated that the course was monitored
Saturday, Sunday and Monday for approximately six hours and only three
balls went over the fence during that time and none landed in the
Rodvold's yard. He stated the monitoring started today full -time. He
added the situation needs to be monitored for at least 30 days to
document exactly how many balls are hit over the fence. He feels the
problem has been exaggerated. Neighbors on both sides of the
Rodvold's home do not agree with the amount of balls claimed to have
gone over the fence. Mayor Berndt asked for Council to be updated on
the monitoring. Council member Barnett expressed concern over the
City's liability if someone is hurt with an errant golf ball.
Assistant City Attorney Tree commented that individual golfers are
responsible for the liability. Mrs. Rodvold_stated that she has
proof to show where the balls landed on' Mier property:' 1,
Gloria Salatino, 904 S. 40th Avenue, stated that she has lived by the
ninth hole of the golf course for eleven years. Approximately 100
golf balls land in their yard each year. She commented that anyone •
living by a golf course has to expect golf balls in their yard. She
has had only three windows broken during these years and they were
• paid for by. the young men who broke them. She stated that over the
week -end they received five balls in their yard.
Mary Cashman, 4407 Carriage Hills Drive, stated that the golf course
is a good alternative for youth to using drugs and a good healthy
sport for all. She reminded Council that thousands enjoy the sport
and park and asked they not put any restrictions on Fisher Park.
Kay Smith, 813 S. 38th Avenue, brought a signed statement supporting
the monitoring, before spending the money for netting or fences. The
residents all enjoy the Park and feel the errant golf balls.are not a
serious threat. They consider the Golf Course an asset. She read the
names of neighbors whom have received golf balls in their yards and
' the amount of balls; all are in agreement that they do not pose a real
problem: R.K. & Kay Smith, Dr. & Mrs. K. Weingarten, Don & Cindy
Guthrie, Mr. & Mrs. Charles Pogatchnik, Margaret Sullivan, Mike and
Reggie Williams, Mr. & Mrs. Ron Larin, Dorothy Watson.

Ms. Schickert, 612 S. 7th Street, spoke to the Council about the
concern of herself and neighbors about drugs, hookers, garbage, etc.,
in her neighborhood. She feels not enough is being done to clean up
the City. She described several incidents that occurred in her
neighborhood, including her house being robbed seven times, her
daughter being propositioned, her niece being offered drugs, and
having her life threatened. She states there is a "crack house" on
the corner . of 6th Street, across from the school. Council member
Beauchamp agreed with her assessments. Mr. Beauchamp feels. the
landlords should be advised that they cannot continue to make a profit
by renting housing to drug dealers. He said the City should be
aggressively enforcing the nuisance abatement laws upon the landlords.
Captain Blesio replied that the Police Department has put pressure on
the homes Ms. Schickert mentioned. Landlords have been forced to
evict tenants but they consistently move back into the homes with
alleged names, identifications, etc. Capt. Blesio stated the City
needs more money and personnel to handle these problems. Chief Green
replied about 60 -70% of the people arrested are known on a first -name
• basis. He stated they need more jail room. Mr. Beauchamp
questioned, for the benefit of the County Commissioners present, that
if there is such a shortage of jail space why are so many traffic
offenders arrested and jailed for minor traffic offenses? Chief Green
stated that these offenders have been arrested many times for failure
to pay their fines before they are jailed. Mr. Beauchamp disagreed.
Items Nos. 5 and 6 were discussed out of sequence of the agenda, but
sequence for minutes was kept.
5. APPROVAL OF THE MINUTES OF THE COUNCIL MEETING OF MARCH 20, 1990
It was MOVED BY BUCHANAN, SECONDED BY SIMS, TO APPROVE THE MINUTES OF
MARCH 20, 1990. The motion carried by unanimous voice vote. Pechtel
absent.
6. PRESENTATION FROM CABLE TV REGARDING EFFECTIVE USE OF VIDEOS'

City Manager Zais introduced Wendy Warren, Programming Coordinator of
Yakima Community TV. Ms. Warren gave a video presentation, showing
the basic format on how to prepare a successful video. She stated 70%
of the work is in proper planning. She said the video shown was
eleven minutes long; however, it took forty eight hours to produce.
7. PRESENTATION FROM CITY OF GRANDVIEW REGARDING PRISON CONSTRUCTION
PROGRAM
Carl Stevens, Mayor of Grandview, petitioned the Council for support
of a medium security prison in the Grandview area. Grandview is an
agriculture community and looks to the possibility of the prison, as
another industry, to enhance the working population. The prison would
add about 400 jobs to the area. He stated that prison staffing
has been upgraded, and would help Grandview College students to obtain
employment, in the area, as they graduate. The prison would take
approximately four years to build and will be located approximately
four miles east of Mabton. It was MOVED BY BARNETT, SECONDED BY
BUCHANAN, TO.WRITE A LETTER OF SUPPORT FOR GRANDVIEW'S PROPOSAL FOR A
MEDIUM SECURITY PRISON. The motion carried by unanimous voice vote.
Pechtel absent.
8. REPORT FROM DEPARTMENT OF COMMUNITY AND ECONOMIC DEVELOPMENT REGARDING
DRAFT ANNEXATION STRATEGIES PROGRAM
City Manager Zais introduced the issue and advised.Council.that County
Commissioners Chuck Klarich and Alex Deccio were present to address
the issue. Associate Planner John Elsden, discussed the City's policy
since 1965, to annex properties requesting sewer and /or water
services. The proposed annexation strategies would begin to implement
some of these policies which have developed in the past 20 -25 years.
Under Option No. 3, once an area has been determined by staff to be
•
feasible or logical to be annexed, no hook -ups would be allowed until
annexation of the area is completed. This would require a petition
signed by owners of 75% of the assessed value of the area. If there

is an imminent health hazard, the area can receive service regardless
of annexation, through an LID. Council member Barnett asked if Option
3 violates the terms of the agreement and the Urban Area Plan as it
.relates to sewer. Mr. Elsden stated the 1976 Wastewater Agreement was
signed, requiring people wanting water and /or sewer service to
immediately annex, if feasible. Staff also clarified that it was not
the intent, under Option 3, to require immediate annexation of areas
where it is not feasible to annex. County Commissioner Chuck Klarich
presented letter contending the City's Option 3 policy could have an
adverse effect on economic growth and development in the urban areas.
The County Commissioners requested a meeting with City officials
within the next 30 days, before adopting this program to discuss urban
area growth strategies. It was MOVED BY SEMON, SECONDED BY BUCHANAN,
TO DIRECT STAFF TO REVISE THE WORDING IN OPTION 3 AND BRING IT BACK TO
THE COUNCIL IN LEGISLATIVE FORM; TO BE TAKEN TO THE COUNTY FOR A JOINT
MEETING AND DISCUSSION WITHIN THE NEXT 30 DAYS. The motion. carried by
unanimous voice vote. Pechtel absent.
9. OTHER BUSINESS
Council member Sims stated that four candidates had been interviewed
for the Housing Authority Board. It was MOVED BY SIMS, SECONDED BY
BUCHANAN, TO APPOINT DAN FOLEY TO THE HOUSING AUTHORITY BOARD. The
motion carried by unanimous voice vote. Pechtel absent.
Council member Sims stated that a conflict of interpretation exists
between the City of Yakima, Union Gap and property owners regarding
City services on Washington Avenue. It was MOVED BY SIMS, SECONDED BY
BEAUCHAMP, TO DIRECT STAFF TO REVIEW HOW THE 1987 UNION GAP - YAKIMA
UTILITY SERVICE AGREEMENT IS BEING APPLIED TO SERVICE REQUESTS ALONG
WASHINGTON AVENUE AND MAKE RECOMMENDATIONS TO BETTER SERVE THESE
INDIVIDUALS, AND REPORT BACK TO THE COUNCIL IN TWO TO THREE WEEKS.
The motion carried by unanimous voice vote. Pechtel absent.
Council member Barnett advised the Council that candidates are being
interviewed for the Yakima Center Advisory Commission. That Committee
consists of Council members Barnett, Buchanan and Sims. Council
member Sims reported the Community Development Advisory Committee is
interviewing individuals to serve on that committee.
10. EXECUTIVE SESSION REGARDING DISPOSITION OF PROPERTY, COLLECTIVE
BARGAINING, AND PROSPECTIVE LITIGATION
It was MOVED BY BUCHANAN, SECONDED BY SIMS, TO MOVE INTO EXECUTIVE
SESSION FOR THE PURPOSE OF DISCUSSING DISPOSITION OF PROPERTY,
COLLECTIVE BARGAINING, AND PROSPECTIVE LITIGATION WITH IMMEDIATE
ADJOURNMENT THEREAFTER UNTIL TUESDAY, APRIL 10, AT 7:00 A.M. AT THE
HOLIDAY INN FOR AN INFORMAL BREAKFAST MEETING. The motion carried by
unanimous voice vote. Pechtel absent.
11. ADJOURNMENT
Following the completion of Executive Session, the meeting was
adjourned at the hour of 5:20 P.M.to meet again on April 10th,
1990, at 7:00 A.M. at the Holiday Inn. Council member Barnett absent
after 5:05 P.M.
