AN ORDINANCE relating to administration, specifying the residency status for certain
members appointed to the Yakima Arts Commission; and amending YMC
section 1.36.030 of the Yakima Municipal Code.
Section 1. Section 1.36.030 of the City of Yakima Municipal Code is amended to read as
follows:
1.36.030 Membership and terms of service. The Yakima Arts Commission
shall have no less than thirteen (13) and no more than fifteen (15) members
comprised as follows:
A. Two working artists ( "working artist" shall be a person who has had their works
of art exhibited in professional gallery spaces and /or has had their work included in
professionally juried exhibitions or permanent collections);
B. Four to six community members, of which at least three shall be residents of
the City of Yakima. The community members shall be from diverse backgrounds
and shall have no vested interest in any particular art or cultural endeavor;
C. Six persons each of whom represent one of the following six professionally
staffed local arts organizations — The Yakima Symphony Orchestra, The Capitol
Theatre, Allied Arts of Yakima Valley, the Seasons Music Festival, the Larson
Gallery, and the Yakima Valley Museum;
D. One member of the Yakima City Council.
All members shall be appointed by the Yakima City Council. The initial
Commission members shall serve staggered terms. One -third of the initial total
membership shall be appointed for an eighteen (18) month term, one -third shall be
appointed for a thirty (30) month term, and one -third shall be appointed for a forty -
two (42) month term. Thereafter, appointed members shall each serve a four (4)
year term, with each term ending on June 30 of its termination year. No member
shall serve for more than two (2) four (4) year terms.
Section 2. This ordinance shall be in full force and effect 30 days after its passage,
approval, and publication as provided by law and by the City Charter.

SUMMARY EXPLANATION:
A. On January 5, 2010, the Yakima City Council passed Ordinance 2010 -01, establishing the
Yakima Arts Commission.
On February 18, 2010, the Council Rules and Procedures Committee acted to add a
residency requirement for the Commission. Language has been added to the Membership
and Terms of Service section to require that of the four to six community members
appointed; at least three shall be residents of the City of Yakima.
The recommended action would amend Section 1.36.030 of the Yakima Municipal Code.

B. Also on February 18, the Council Rules and Procedures Committee moved to forward the
names previously recommended by the Nominating Committee to the full Council for
appointment once it has been determined that the residency criteria is met.
It has been confirmed that four of the six community members are city residents.

STAFF RECOMMENDATION:
BOARD /COMMITTEE /COMMISSION RECOMMENDATION: On January 12th, the Council
Nomination Committee recommended for approval the attached nominations for the Yakima
Arts Commission. On February 18th, the Council Rules and Procedures Committee
recommended for approval the change in residency requirements and forwarded for approval
the attached nominations.

Subject: Yakima Arts Commission
The Council Rules and Procedures Committee met on February 18, 2010 and approved
a motion to modify the legislation establishing the Yakima Arts Commission. The
modification would require the Community Representation category to contain at least
three city residents. The amendment to the ordinance is an agenda item for the March
2 "d City. Council Meeting.
Based on the recommendation, the Committee reviewed the applicants that were
previously submitted for the Arts Commission and the requirement was met by four
nominees. Therefore, the Nomination Committee is resubmitting the nominees to the
Arts Commission as follows:

Mayor Cawley was appointed committee chair by consensus.
2) 0 Discussion re: committee tasks and assignments, and the necessity of the
committee
City Manager Zais gave an overview of the purpose of the committee giving examples of
decisions made in the past (establishment of debate procedures).
3) 0 Discussion re: residency requirements for citizen boards /committees/
commissions

Bill Cook mentioned the idea of strategic alliances with outside communities. Council
Member Coffey pointed out the practicality of having the first commission populated with
people that are going to help guide the process and possibly address the residency
issue later. Following discussion, ETTL MOVED AND COFFEY SECONDED TO
MODIFY THE REQUIREMENTS TO STATE THAT THE COMMUNITY
REPRESENTATIVE POSITIONS MUST CONTAIN AT LEAST THREE MEMBERS
THAT ARE CITY RESIDENTS AND TO FORWARD THE NAMES PREVIOUSLY
RECOMMENDED BY THE NOMINATING COMMITTEE TO THE FULL COUNCIL FOR
APPOINTMENT ONCE IT IS DETERMINED THAT CRITERIA IS MET. The motion
carried by unanimous voice vote.
- Consider recommendation to full City Council re: proposed City Planning
Commission residency requirements
Joan Davenport distributed a draft ordinance that would establish the City of Yakima
Planning Commission. She pointed out it would have four year terms with a two -term
limitation. Council Member Coffey recommended changing the wording regarding
staggering the terms of the initial committee to ensure term expirations would not all

occur the same year. The proposed ordinance has city residency requirements.
CAWLEY MOVED AND COFFEY SECONDED TO MOVE THE PROPOSED
ORDINANCE FORWARD TO THE FULL COUNCIL WITH THE RECOMMENDED
WORDING CHANGE REGARDING STAGGARED TERMS. The motion carried by
unanimous voice vote.
- Review and consider city residency requirements for all boards, commissions
and committees
Following direction from the Council at the January 19 business meeting, the committee
reviewed all boards /committees /commissions individually and determined that
standardizing residency requirements was not advisable due to membership expertise or
state law regulations.
The following residency requirement changes are recommended to the full Council:
Air Terminal Board — The two -city appointed members should be city residents
Parks & Recreation Commission — Require City residency. Current members will be
grandfathered in.
REQUIRED ACTION: Submit to the full Council for approval and direct the Legal
Department to prepare appropriate legislation to implement the recommended changes.

City Manager Zais alerted the committee members of a letter from the Yakima County
Commissioner's office asking the City to delay the March 5, 2010 Washington Heights
Annexation. The County believes it should be a more extended area, which would
require additional time to accomplish. The developer does not want the delay. City staff
will evaluate the request.
