ORDINANCE NO. 2004- 71 AN ORDINANCE concerning land use and zoning; rezoning the property located at 711 West Walnut Avenue, Yakima, Washington (Yakima County Assessor's Parcel No. 181324 - 42502) from Multi - Family Residential (R -3) to Professional Business (B -1); and amending the Official Yakima Urban Area Zoning Map to reflect said rezone. WHEREAS, Kenneth G. Ormbeck, AIA, on behalf of Next Step Housing ( "Owner "), submitted an application to rezone certain property located at 711 West Walnut Avenue, Yakima, Washington (Yakima County Assessor's Parcel No. 181324 - 42502) from Multi - Family Residential (R -3) to Professional Business (B -1) (referred to below as the "Subject Property "); and WHEREAS, on August 26, 2004, the Hearing Examiner for the City of Yakima conducted an open- record public hearing regarding the requested rezone (UAZO RZ #4 -04) and after considering the record issued Hearing Examiner's Recommendation, dated September 9, 2004; and WHEREAS, the Hearing Examiner recommended that the Subject Property should be rezoned from Multi- Family Residential (R -3) to Professional Business (B -1) subject to certain conditions; and WHEREAS, at a closed- record public hearing on November 2, 2004, the City Council considered the requested rezone, including the documents and other evidence which comprise the record developed before the Hearing Examiner, the Hearing Examiner's Recommendation, and the statements of interested persons; and WHEREAS, the City Council finds that the considerations of the Hearing Examiner in response to the requirements and criteria of YMC 15.23.030(E) are correct and appropriate, and that the same should be adopted by the City Council as its findings herein; and WHEREAS, it is in the best interests of the City to enact the following to approve the requested rezone, now, therefore, 1 BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The property located at 711 West Walnut Avenue, Yakima, Washington (Yakima County Assessor's Parcel No. 181324 - 42502), and legally described as: Lots 9, 10, 11, 12,13 & 14, Block 332, Capitol Addition is hereby rezoned from Multi - Family Residential (R -3) to Professional Business (B -1). Section 2. The findings contained in the September 9, 2004, Hearing Examiner's Recommendation (UAZO RZ #4 -04, EC #19 -04) regarding this rezone are hereby adopted by the City Council as its findings in support hereof pursuant to YMC 15.23.030(F) and are incorporated by this reference as if fully set forth herein. A copy of said Hearing Examiner Recommendation is attached hereto as Exhibit "A." Section 3. The Official Yakima Urban Area Zoning Map and all other zoning and land use maps shall be amended or modified, subject to conditions stated below, to rezone the Subject Property from Multi - Family Residential (R -3) to Professional Business (B -1). Section 4. a The rezone granted by this ordinance is expressly conditioned on the Owner's satisfaction of the following conditions stated on pages 8 -9 of the Hearing Examiner's Recommendation: a. The site plan submitted with the application shall serve as the final site plan. b. A key box shall be installed to comply with Chapter 4, Section 506 of the International Fire Code. c. Any future construction or renovation on the Subject Property is subject to plan review by the City of Yakima and to the Owner's obtaining all necessary and appropriate permits from the City of Yakima, including but not limited to a building permit. d. If a future change in use is proposed for the Subject Property, all applicable development standards shall be met. Adjustments will be considered and possibly approved only following prescribed public notice and comment requirements. 2 Section 5. If any section, subsection, paragraph, sentence, clause or phrase of this ordinance is declared invalid or unconstitutional for any reason, such decision shall not affect the validity of the remaining portions of this ordinance. Section 6. The City Clerk is hereby authorized and directed to file a certified copy of this ordinance with the Yakima County Auditor. Section 7. This ordinance shall be in full force and effect 30 days after its passage, approval, and publication as provided by law and by the City Charter. The Hearing Examiner conducted a public hearing on August 26, 2004, and has issued this Recommendation within ten business days thereof. The staff report presented by Associate Planner Mary Lovell recommended approval of the rezone application with conditions. The applicant's representative explained that the purpose of this rezone request is to satisfy one of the funding requirements to have five percent commercial use within this affordable and special needs apartment complex. No testimony or other evidence was submitted in opposition to the requested rezone. Summary of Recommendation. The Hearing Examiner recommends approval of this rezone application by the Yakima City Council, subject to conditions. Next Step Housing 1 Rezone from R -3 to B -1 711 West Walnut Ave RZ # 4 -04, EC #19 -04 EX I 1 1 "A" Basis for Recommendation. Based upon a view of the site without anyone else present on August 25, 2004; the information contained in the staff report, exhibits, testimony and other evidence presented at an open record public hearing on August 26, 2004; and a review of both the Yakima Urban Area Comprehensive Plan and the Yakima Urban Area Zoning Ordinance; the Hearing Examiner makes the following: FINDINGS Applicants. The applicant is Ken Ormbreck for Next Step Housing, 1460 North 16 Avenue, Yakima, WA 98902. Location. The location of the proposed rezone is a parcel containing an existing apartment complex at 711 West Walnut Avenue, Yakima, Washington; parcel number 181324- 42502. Application. This application requests a rezone of one parcel containing an apartment complex from the Multi- Family Residential (R-3) zoning classification to the Professional Business (B -1) zoning classification. An apartment complex owned and .operated by a non - profit affordable housing provider named the Summerset West Apartments is located on the parcel. The applicant was granted a 40 -year deferred loan from the Washington State Housing Trust Fund to provide affordable housing for low income and special needs tenants. But a condition of another funding source for the facility requires dedication of five percent of the total square footage for commercial use. This rezone would allow space to be utilized for commercial use in addition to the leasing office and maintenance shop Next Step Housing 2 Rezone from R -3 to B -1 711 West Walnut Ave RZ # 4 -04, EC #19-04 currently on the premises. The applicant would probably convert a one - bedroom unit to commercial space that could be rented by a service provider, although the exact use is unknown. The predominant use of the parcel for multi - family residential purposes would continue to be permitted as a Class (1) use under the B -1 zoning. Notices. Notices for the SEPA processes and the public hearing were provided in accordance with applicable ordinance requirements in the following manner: Mailing of notice of SEPA review and public hearing July 9, 2004 Posting of public hearing notice on property July 30, 2004 Publishing of public hearing notice August 3, 2004 Mailing of notice of SEPA determination August 4, 2004 Publishing of SEPA determination August 4, 2004 State Environmental Policy Act. A Determination of Nonsignificance was issued by the City of Yakima on August 4, 2004, after the 20 -day comment period failed to result in any comments relative to the proposal. There was no appeal of the DNS within the 15 4lay appeal period ending on August 19, 2004. Current Zoning and Land Uses. The site is improved by an apartment complex and is currently zoned R -3. The existing zoning and the land uses which currently exist on adjacent properties are: Location Zoning Land Use North R -3 Residential South R-3 Multi - family residential West B -1 Hospital East R -3 Mixed commercial /residential Next Step Housing 3 Rezone from R -3 to B -1 711 West Walnut Ave RZ # 4 -04, EC #19-04 Rezone Review Criteria. Recommendations regarding rezone applications within the Yakima Urban Area must be based upon criteria specified in Section 15.23.030 of the Urban Area Zoning Ordinance (UAZO): 1. The testimony at the public hearing: The testimony at the hearing consisted of testimony by Associate Planner Mary Lovell and the applicant's representative John Mifsud who favored approval of the rezone request. No one testified in opposition to the request. 2. The suitability of the property for uses permitted under the proposed zoning: The property is suitable for B -1 uses to the extent that funding requirements only require five percent of the square footage to be utilized for commercial purposes, leaving the vast majority of the property available for its current multi - family residential uses. Since only one unit, probably a corner unit, • will probably be adapted to a professional office use, rezoning the property to B -1 would cause little change in the existing residential use of the property. 3. Recommendations from interested agencies and departments: No agencies or departments have submitted recommendations regarding this rezone request. 4. The extent to which the proposed rezone is in compliance with and /or deviates from the goals and policies as adopted in the Yakima Urban Area Comprehensive Plan and the intent of the Zoning Ordinance: a) The Comprehensive Plan: The Future Land Use Map (Map III -3) of the Yakima Urban Area Comprehensive Plan designates the subject property as suitable for High Density Residential development. The Future Land Use Map to Zoning Map Consistency Chart, Figure III -3, indicates that the Professional Business (B -1) zoning district may be compatible with the High Density Residential designation. The proposed rezone would be in compliance with Objectives and Policies of the 1997 Comprehensive Plan such as Objective G1.1 Next Step Housing 4 Rezone from R -3 to B -1 711 West Walnut Ave RZ # 4 -04, EC #19-04 which is to encourage the physical development of the Yakima Urban Area in a manner that enhances its image as the cultural and business center; Policy G1.1 which is to strive to ,make the Yakima urban area the center for activities throughout the Yakima Valley by forming public /private partnerships that diversify the economic, cultural and service opportunities offered in the urban area; Policy G9.4 which is to encourage commercial, industrial, office and multi- family developments tol locate in distinct clusters in planned growth areas; Policy C8.2 which is to encourage major commercial, industrial and multi - family developments to locate within city limits; Policy H3.8 which is to develop a comprehensive approach to neighborhood improvement; and Policy C2.3 which is to allow and encourage small scale mixed -use retail/residential /professional development within neighborhoods. b) The Zoning Ordinance: Subsection 15.03.030(5) of the UAZO states that the purpose of the B -1 zoning district is to establish and preserve areas for professional offices; provide a buffer between commercial clusters and residential neighborhoods; and locate professional offices in areas presently receiving a full range of urban services. A mix of professional offices and multi - family dwellings may be the primary uses in the district. Chapter 15.05 of the UAZO establishes basic development requirements as minimum criteria which must be met to assure land use compatibility and promote the public health, safety and general welfare. The zoning ordinance sets forth specific standards for minimum lot size, maximum lot coverage, minimum building setbacks, requisite parking, maximum building height and requisite sight screening. The existing structure on the subject parcel currently meets all site design and improvement standards. If a future change is proposed at this site, all applicable development standards will be satisfied unless adjustments are approved following the prescribed public notice and comment requirements. Next Step Housing 5 Rezone from R -3 to B -1 711 West Walnut Ave RZ # 4 -04, EC #19-04 5. The adequacy of public facilities such as roads, sewer, water and other required public services: The property is currently served by all necessary public facilities and services. The property has frontage on West Walnut Avenue and South 8 Avenue which are both classified as Local Access Streets. The development services team meeting held on July 21, 2004 resulted in comments from the Engineering Division to the effect that the project is not subject to Title 12 Development Standards. Even though the rezone application has been determined to be exempt from the Transportation Capacity Management Ordinance, the City Traffic Engineer will determine if concurrency review is required when a specific B -1 use is proposed for the property. The Fire Department notes that since the existing fencing prevents emergency vehicle access, a key box will have to be installed to comply with Chapter 4, Section 506 • of the International Fire (Code: 6. The compatibility of the proposed zone change and associated uses with neighboring land uses: The proposed zone change and associated uses would be compatible with neighboring land uses because the existing residential use of the property would continue with little physical change to the property and little change in the use of the property. Compatibility of the future B -1 use of a small portion of the property would be determined by reference to Table 4 -1, Permitted Land Uses, of the UAZO. In view of the zoning classifications and existing uses of the neighborhood, conversion of one or more units within the residential facility to professional offices would be compatible with the neighborhood. 7. The public need for the proposed change: The testimony at the hearing established that affordable and special needs housing of the quality of this award - winning facility are a benefit to the City and the community. Facilitating Next Step Housing 6 Rezone from R -3 to B -1 711 West Walnut Ave RZ # 4 -04, EC #19-04 compliance with funding criteria for this needed type of service to the public serves a public need. Consistency of the Rezone with Development Regulations and the Comprehensive Plan under the Criteria Required by YMC 16.06.020(B) is determined by consideration of the following factors: a) The types of land uses permitted at the site in the Professional Business (B -1) zoning district would under the circumstances presented by this application be consistent with the Comprehensive Plan's High Density Residential (R -1) designation of the site. b) The density of residential development or the level of development such as units per acre or other measures of density would not be affected by this rezone application because there would be no additional' residential use of the property and any future commercial use would be conducted within an existing facility. c) The availability and adequacy of infrastructure and public facilities is not an issue relative to this rezone request, but traffic concurrency issues may be presented when the specific type of commercial use is known. d) The characteristics of the development, when the exact type of commercial use becomes known in the future, will have to be consistent with the. B -1 zoning provisions and the applicable development regulations. CONCLUSIONS 1. The Hearing' Examiner has jurisdiction to make a recommendation to the City Council regarding this rezone application. Next Step Housing 7 Rezone from R -3 to B -1 711 West Walnut Ave RZ # 4 -04, EC #19-04 2. The public notice requirements of Chapters 15 and 16 of the Yakima Municipal Code have been satisfied. 3. SEPA review resulted in the issuance of a Declaration of Non - significance on August 4, 2004, without any appeal being filed. 4. Adequate public services are available to satisfy the utility and access requirements of future commercial uses on this property, but traffic concurrency may be reviewed when the specific commercial use of the property becomes known in the future. 5. All of the testimony at the hearing was in favor of this rezone request. 6. The requested rezone satisfies the seven criteria in Section 15.23.030 of the UAZO to allow for approval of the requested rezone. RECOMMENDATION The Hearing Examiner recommends that this application for a rezone of property described in UAZO RZ #4 -04 from the Multi- Family Residential (R -3) zoning classification to;, the Professional Business (3-1) zoning classification be APPROVED by the Yakima City Council, subject to the following conditions: 1) The site plan submitted with the application shall serve as the final site plan. 2) A key box will have to be installed to comply with Chapter 4, Section 506 of the International Fire Code. The compatibility of the proposed zone change and associated uses with neighboring land uses: The proposed zone change and associated uses would be compatible with neighboring land uses because the existing residential use of the property would continue with little physical change to the property and little change in the use of the property. Compatibility of the future B -1 use of a small portion of the property would be determined by reference to Table 4 -1, Permitted Land Uses, of the UAZO. In view of the zoning classifications and existing uses of the neighborhood, conversion of one or more units within the residential facility to professional offices would be compatible with the neighborhood. 7. This is a non - project rezone, and no development proposal has been submitted. This application is subject to approval. The application was considered complete for processing on July 1, 2004.
