HomeMy WebLinkAbout2004-077 REET 2 funding ORDINANCE NO. 2004-- 77 AN ORDINANCE to amend the Yakima Capital Facilities Plan; which, by extension, amends the City of Yakima's Comprehensive Plan to identify the paving of gravel streets and certain arterial and unclassified street maintenance projects as allowable for REET 2 funding. WHEREAS, the Yakima City Council adopted by Resolution (R- 2004 -122) on August 3, 2004, initiating the consideration of an amendment to the Capital Facilities Element of the Yakima Urban Area Comprehensive Plan, in conjunction with other associated capital facilities planning documents, to provide for the use of the Second Quarter Percent Real Estate Excise Tax (REET2) funds for arterial street maintenance and the paving of gravel streets; and WHEREAS, the City of Yakima has completed the public process as contemplated in GMA and in YMC Section 16.10.070, which consisted of SEPA Review (DNS) posting on the City website, notices to normal reviewing agencies and interested parties, legal advertisement, CTED, public meeting on August 3, 2004 and City Council Public Hearing on October 19, 2004; and WHEREAS, the Yakima City Council concurrently approved a 5 -Year Expenditure Plan for expending REET2 funds for unclassified and arterial street maintenance, Multi -Year Chip Seal Plan for unclassified street maintenance, paving of gravel streets and other allowable activities; and WHEREAS, the funding capacities and identified sources for financing of necessary capital facilities, including transportation projects, is a core requirement of the Washington State Growth Management Act, as expressly described in RCW 36.70A.070(6), now therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF YAKIMA, WASHINGTON: SECTION 1. That the Yakima Capital Facilities Plan page 124, "Financing Policies /Responsibilities — Capital Improvements" shall be amended to read as follows: Item 6. WHEREAS, the Yakima City Council established a citizen advisory committee entitled the Capital Facilities Committee in June of 2002 to study and recommend options for financing needed improvements t� Arterial Streets and the paving, of gravel streets. On July 1, 2003 this Committee recommended the City enact the Second Quarter Percent Real Estate Excise Tax as one method to finance these public improvements; and . WHEREAS, the City of Yakima adopted the Second Quarter Percent Real Estate Excise Tax on October 21; 2003 after public testimony received during public hearings on September 2, 2003 at 2:00 p.m.; September 16, 2003, at 7:30 a.m. and September 30, 2003 at 7 :00 p.m.; and • WHEREAS, the 2004 City of Yakima Budget, adopted on December 16, 2003, by Ordinance No. 2003 -73 includes the authorization and appropriation of funds collected from the Second Quarter Percent Real Estate Excise T.ax into a separate and.dedicated account, as required by RCW 82.46.035(4). Additionally, Resolution No. R- 2003 -136 directed , consideration of the project and financing options into the Updates of the Comprehensive Plan, the Transportation Plan, and the Capital facilities Plan;, and WHEREAS, the "City of Yakima Capital Facilities Plan, 1996-2001," adopted into the Yakima Urban Area Comprehensive Plan on April 1, 1997, describes the condition of city streets, including the presence of gravel and dirt streets or alleys, many of which have been incorporated into the city maintenance system largely through annexations (page 29, Transportation Capital Facilities). Transportation Funding Options are listed on page 37 of the Capital Facilities Plan including the recommendation for adopting the Second Quarter Percent Real Estate Excise Tax; and WHEREAS, the., Yakima Urban Area Comprehensive Plan describes the general location, distribution and intensity of land uses within. the Urban Area, as well as population densities and future growth potential. The Capital Facilities Element of the Comprehensive Plan summarizes specific projects and funding programs for necessary public facilities including Transportation improvements and air quality measures. Consistency between the various required elements of the Comprehensive Plan, including the Capital Facilities Plan, is one of the basic tenets of the Washington State Growth Management Act; and WHEREAS, the Yakima Urban Area Comprehensive Plan identifies as a primary objective to Protect and Improve Local and Regional Air Quality (Page 11-49), including policies that support the cooperation with the Yakima Clean Air Authority to, coordinate air quality programs and implementation measures. Transportation alternatives are evaluated in the Comprehensive Plan for affect on congestion and air quality (page V -10); and WHEREAS, the public health and air quality benefits of paving gravel streets has been widely documented and broad public support given during public hearings for the need to mitigate and reduce related dust emissions from unpaved streets; and WHEREAS, S, the funding capacities and identified sources for financing of necessary capital facilities, including transportation projects, is a core requirement of the Washington State Growth Management Act (GMA), as expressly described in RCW 36.70A.070(6); and WHEREAS, GMA allows for the amendment of the capital facilities element of a comprehensive plan to occur . more frequently than once per year, if such an amendment occurs concur tntly with the adoption or amendment of a city budget, pursuant to RCW 36.70A.13.0(2)(a)(iii); and WHEREAS, Yakima. Municipal Code (YMC) section 16.10.035 provides that consideration of any such amendment as may comply with RCW 36.70A.130(2)(a)(iiii) shall be initiated. by resolution, following which public notice of such a proposed amendment shall occur; and WHEREAS, an.amendment to the Capital Facilities Element of the Yakima Urban Area Comprehensive Plan, in conjunction with other associated capital facilities planning documents, to allow for the use of BEET 2 funds as described herein, provided that any such amendment is adopted concurrently with the adoption or amendment of the City budget, constitutes an amendment authorized by RCW 36.70A.130; and WHEREAS, the importance of public health and air quality .benefits and the ability to provide for a timely and predictable process for capital facilities planning for the City of Yakima renders it detrimental to the public interests for this amendment to be deferred until.the next annnal comprehensive plan amendment cycle; now therefore, • BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAIIIA: • 1. The State of Washington is authorized to levy a real estate excise tax on all sales of real estate, measured by the full selling price, including the amount of any liens, mortgages and other debts given to secure the purchase at a rate of 1.28 percent. RCW 82.45.060. A locally - imposed tax is also authorized. However, the rate at which it can be levied and the uses to which it may be put differs by city or county size and whether the city or county is planning under the Growth Management Act (GMA). All cities and counties may levy a quarter percent tax (described as "the first quarter percent of the real estate excise tax" or "REST 1"). RCW 82.46.010. Cities and counties that are planning under GMA have the authority to levy a second quarter percent tax (REET 2). RCW 82.46.035(2). Note that this statute specifies that if a county is required to plan under GMA, or if a city is located in 1, such a county, the tax may be levied by a vote of the legislative body. if however, the county chooses to plan under GMA, the tax must be approved by a majority of the voters. Tow Can the First Quarter Percent — REET 1 Be Spent? Cities and counties fall into three categories: 1) those that are not planning under GM_ 2) those that are planning under GM_A, but have a population under 5,000; and 3) those that are planning under GMA and have a population of 5,000 or over. Cities and Counties That Are Not Planning Under GMA and Those That Are Planning But Have a Population Under 5.000. Both groups of entities have the same restrictions on their spending of REST 1 revenues. They must use these funds "for any capital purpose identified in a capital improvements plan and local capital improvements, including those listed in RCW 35.43:040." RCW 82.46.010(2). RCW 35.43.040 lists local improvements that can be funded. through a local improvement district (LID), including streets, parks, sewers, water • mains, swimming pools and gymnasiums, etc. (Note that in chapter 272, Laws of 1994, the le6slaiure clarified its original intent that "local capital improvements" was intended to include the acquisition of real and personal property associated with such local.capital improvements. This means that land acquisition for parks is a permitted expenditure.) Capital projects not listed in the LID statute (for example, a fire station, city hall, courthouse or library) are also permitted uses as long as they are included in the city's or county's capital improvement plan. Expenditures that are not allowed are such things as the purchase of police cars. These jurisdictions must spend the first quarter percent of their real estate excise tax receipts solely on capital projects that are listed in the capital facilities plan element of their comprehensive plan. RCW 82.46.010(2)(6). RCW 82.46.010(6) defines "capital projects" as: those public works projects of a local government for planning, acquisition, construction, reconstruction, repair, replacement, rehabilitation, or improvement of streets; roads; highways; sidewalks; street and road lighting systems; traffic signals; bridges; domestic water systems; storm and sanitary sewer systems; parks; recreational facilities; law enforcement facilities; fire protection facilities; trails; libraries; administrative and judicial facilities... Spending the Second Quarter Percent — REET 2 • • This part of the real estate excise tax may only be levied by cities and counties that are required to or choose to plan under the Growth Management Act. All cities and counties that levy this tax face the same provisions, whether their population is greater or less than 5,000. For this quarter percent of the real estate excise tax, "capital project" means those: public works projects of a local government for planning, acquisition, construction; reconstruction, repair, replacement, rehabilitation, or improvement of streets, roads, highways, sidewalks, street and road lighting systems, traffic signals, bridges, domestic water systems, storm and sanitary sewer systems, and planning, constriction, reconstruction, repair, rehabilitation, or improvement of parks. RCW 82.46.035(5). Note that acquisition of land for parks is not a permitted use of BEET 2 receipts, although it is a permitted use for street, water, and sewer projects. What's the Half Cent Tax Shown in RCW 82.46.010(3)7 Cities and counties that are not levying the optional half -cent sales tax under RCW 82.14.030(2) have the option of levying an additional one -half percent real estate excise tax. These receipts are not designated for capital projects. They are a general fund revenue for city operating expenditures. Only • two cities, Asotin and Clarkston, have chosen to do this. From a financial standpoint, the optional half -cent sales tax will probably bring in more revenue than this additional one -half percent real estate excise tax For border cities and counties, however, who do not feel they are able to levy the optional sales tax, this tax is a revenue option_ .. The imposition of this tax, a change in rate, or repeal of the tax is subject to the referendum procedures given in RCW 82.46.021. • One Percent Real Estate Excise Tax for Conservation Areas. A county legislative authority may submit a ballot proposition to the voters for an additional real estate excise tax on each sale of real property in the county at a rate not to exceed 1 percent of the selling price. The revenue from this tax is restricted to the acquisition and maintenance of conservation areas. Accounting for These Funds Because this revenue source has a dedicated purpose, it must be accounted for separately in a capital projects fund. Those cities and counties that are planning under GMA and levying both REET I and REET 2 need to keep track of each of these revenues separately because the uses to which they may be put are different. RCW 82.46.030(2) and RCW 82.46.035(4). Although no special direction is given in the statutes as to how to account for funds collected under RCW 82.46.070 for conservation areas, these should be kept in a separate fund also. Staff respectfully requests City Council approve the attached ordinance amending the Capital Facilities Plan (and by extension, the Comprehensive Plan), and conduct first reading of 2004 Appropriation Ordinance amending the REET 2 Capital Budget. On August 3, 2004, City Council adopted Resolution No. R- 2004 -122 (attached) authorizing the initiation of an amendment to the Capital Facilities and Comprehensive Plans. Staff has appropriately engaged the public process tasks approved by the Planning Division to comply with YMC Section 16.10.070 and Growth Management Act (GMA) requirements. The Public Hearing on October 19, 2004, concluded the public process requirements under YMC 16.10. The State Environmental Policy Act (SEPA) process was initiated on September 10, 2004. The formal DNS was issued on October 4, 2004 (attached). Staff has mailed notices to parties of record, placed a legal ad in the Yakima Herald at least 20 days prior to this public hearing (attached), has included a posting on anticipated Determination of the City's website, has sent a Press Release to the Local Media, and placed an announcement on YPAC, all of which encourage public involvement. The State Department of Community, Trade and Economic Development (CTED) was also noticed the week of September 13, 2004. Therefore, 60 days after this notice to CTED has elapsed, City Council may formally act on the REET 2 legislation enabling usage of funds. That 60-day timeline was met in mid- November. The attached material, in response to Council direction, details the REET 2 5 -Year Project Plan and contains maps and lists that specify a multi-year (11 Years) maintenance program for unclassified street maintenance and the Bituminous Surface Treatment (BST) of unpaved streets. The Engineering Division will plan Arterial Grind and Overlay projects that are consistent with the adopted Six-Year TIP, Pavement Management Report and discussions with City Council. All these projects are allowed under REET 2 (RCW 82.46.035(5)- attached). Council Member Ron Bonl.ender requested that consideration be given to allowing REET 2 funds for alley improvements. The "REET 2 5 -Year expenditure Plan" chart has been amended to afford funding eligibility based on future Council direction on specific alley activities /improvements. Staff now returns to City Council with appropriate legislation necessary for allowing the use of REET 2 funds for basic street preservation purposes.
