ORDINANCE NO. 2014 -031
AN ORDINANCE concerning land use regulation and planning and rezoning three
parcels of property located in the vicinity of Highway 12 and North
16 Avenue from Large Convenience Center (LCC) to Light
Industrial (M -1) as more fully described herein, and approving the
recommendation of the Planning Commission for the City of
Yakima regarding the same; Plymouth Ranch, LLC, applicant
herein.
WHEREAS, pursuant to YMC 6.88, the SEPA Administrative Official issued a
Determination of Nonsignificance for each rezone request in accordance with WAC 197-
11 -355, as required under the State Environmental Policy Act; and
WHEREAS, the Planning Commission for the City of Yakima issued a
recommendation on October 22, 2014, (the "recommendation "), recommending that the
City approve the rezoning of three certain parcels of property as more fully described
herein; and
WHEREAS, the City Council finds that the findings of the Planning Commission
set forth in the recommendation in response to the requirements of Yakima Municipal
Code ( "YMC ") § 15.23.030(D) are correct and appropriate, and that the same should be
adopted by the City Council as its findings herein; and
WHEREAS, the City Council finds that it is in the best interest of the City to enact
the following; now therefore:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF YAKIMA,
WASHINGTON:
Section 1. The following parcels of property located in the vicinity of Highway
12 and North 16 Avenue shall be, and the same hereby are, rezoned from Large
Convenience Center (LCC) to Light Industrial (M -1): 181312 - 33001, -33002 and 181313-
22001. Attached hereto and incorporated herein as Exhibit "A" are legal descriptions of
said property.
Section 2. The findings of the Planning Commission's recommendation in
this matter dated October 22, 2014, are hereby adopted by the City Council as its
findings in support hereof pursuant to YMC § 15.23.030(E), and are incorporated herein
by this reference as if fully set forth herein.
Section 3. Any and all zoning, land use, and other similar maps maintained
by the City of Yakima shall be amended or modified to reflect this rezone. The City
Clerk is hereby authorized and directed to file a certified copy of this ordinance with the
Yakima County Auditor.
Section 4. Severability: If any section, subsection, paragraph, sentence,
clause or phrase of this ordinance is declared invalid or unconstitutional for any reason,
such decision shall not affect the validity of the remaining portions of this ordinance.
Section 5. This ordinance shall be in full force and effect 30 days after its
passage, approval, and publication as provided by law and by the City Charter.
PASSED BY THE CITY COUNCIL at a regular meeting and signed and
approved this 18 day of November, 2014.

SUMMARY EXPLANATION:
The Washington State Growth Management Act requires cities and counties to adopt land use
regulations that are consistent with and implement their comprehensive plan. For 2014, the
Yakima Planning Commission held open record public hearings on three requests to amend the
City's Future Land Use Map designation and concurrent requests for rezones; and one request
for a text amendment.
At this time you are being asked to consider their recommendations and determine whether you
will accept, deny or remand any or all of these matters back to the Commission for additional
review. Should you choose to accept their recommendations you have been provided with the
draft of an ordinance which would affect these changes.

RECOMMENDATION:
The Planning Commission recommends that the City Council of the City of Yakima approve the
three Comprehensive Plan Amendments and concurrent rezones and the one text amendment.
Staff recommends acceptance of the Yakima Planning Commission's recommendations and
adoption of the Ordinances provided.
