• AN ORDINANCE amending Section 1 of City of Yakima Ordinance No,
1566, enacted, September 17, 1973, entitled
"AN ORDINANCE providing for the improvement of certai.n'� .
streets by grading, ballasting, surfacing with asphaltic
• concrete and constructing concrete'curbs and gutters,' -
together with the necessary drainage features; establish-

• ing a Local Improvement District, providing for the
method of payment thereof, and'creating a special
fund "; and declaring an emergency. •
.WHEREAS, City of Yakima Ordinance No 1566, enacted Septem-
ber 17, 1973, created a local improvement district and provided by •
Section 1 of such ordinance for the improvement of:
44th Avenue from Chesnut Avenue to Barge Street; •
South one -half of Madera Way from North 48th Avenue to
approximately 300 feet west, and

WHEREAS, at the request of property owners along Madera Way,
the City Council, on December 3, 1973, awarded a contract for the
44th Avenue improvement only with the intention of deleting the
Madera Way improvement'from that local improvement district, and •
.WHEREAS, the improvement of North 44th Avenue has been'per-
formed, and Local Improvement District No. 995 is now ready for
completion making it necessary to amend Section 1 of said Ordinance •
No. 1566 so as to formally delete Madera Way from that district,
now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. Section 1 of City of Yakima Ordinance No. 1566,
enacted September 17, t973, and entitled "AN ORDINANCE providing
for the improvement of certain streets by grading, ballasting, sur-

facing with asphaltic concrete and constructing concrete curbs and
gutters, together with the necessary drainage features; establishing
a Local Improvement District, providing for the method of payment
thereof, and creating a special fund" is hereby amended to read as
follows:
"Section 1. The following street situate in Yakima County

gutters, together with the necessary drainage features:
44th Avenue from Chestnut Avenue to Barge Street;"
Section 2. This ordinance is one to provide for the immediate
preservation of the'public peace, property, health, safety and wel-
fare of the people of the City of Yakima and an emergency is hereby
declared to exist and this ordinance shall be in full force and
effect immediately upon its passage, approval and publication as
provided by law and by the City Charter.
