B -2084 AN ORDINANCE providing for the improvement of certain property by constructing pipe sew- ers with the necessary wye branches and manholes; establishing a Local Imp- rovement District, providing for the method of payment thereof, and creating a special fund. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. That the hereinafter described property in the .City of Yakima, Washington, shall be improved by the construction of pipe sewers with the necessary wye branches and manholes, and by doing such other work as may be necessary in connection therewith, said improvement to serve the property, the boundaries of which are described as follows: Lots 1 to 20 inclusive of Suburban Acre Homes Lots 22 to 29 inclusive of Suburban Acre Homes Lots 32 to 35 inclusive of Suburban Acre Homes Lot 12 of Hunziker Tracts Lots 3, 8 and 9, Block 1 of Stone Addition South 75' of Lot 6, Block 2 of Stone Addition West half of Lot 7, Block 2 of Stone Addition North. 184! of South 204' of West 141' of East 161' of SEg, NW4, SE4 of Section -26, Township 13 North, Range 18, EWM ALL situate in the City of Yakima, Yakima County, Washington. Section 2. There is hereby created and established .a local improvement district to be called "Local Improvement District No. 859 ", which said district shall include all of the property described and set forth in Section 1 hereof. Section 3. All of the cost and espenses of said improvement, including the cost of acquiring right of way eadements, engineering, surveying, advertising, publica- tion of notices, and any other expenses incident thereto shall be levied and assessed against the above described property as provided by law. The assessments for said impr- ovement shall be made according to special benefit derived from the improvement without regard to the zone and termini method. Said improvements shall be made in accordance with the data and information heretofore submitted and filed with the City Commission of the City of Yakima by the City Engineer as required by law. Section 4. All of the aforesaid construction work shall be in accordance with the plans and specifications, profiles, maps and detailed drawings which have been prepared by the City Engineer, filed with the City Clerk, and which are hereby approved and adopted Section 5. All of the work necessary to be done in connection with the mak- ing os said improvement shall be done and made by contract upon competitive bids; and the city shall have the power to reject any and all bids. Section 6. There is hereby created a special fund to be called "Local Impr- ovement Fund, District No. 859 ", into which shall be paid all sums paid on account of the aforementioned special assessment, including all interest and penalties thereon; and in the event of the sale of local improvement bonds by this City, all premiums and interest on said bonds issued for said improvement. Section 7. Bonds bearing interest at the rate of 4% per annum, payable on or before 10 years from date of issuance shall be issued in payment of the costs and ex- penses of, said improvement, which bonds shall be redeemed by the collection of special assessments to be levied and assessed upon the property within the said district, payable in 10 annual installments, with interest at the rate of 4% per annum, interest payable annually under the mode of "payment by bonds" as defined by the statutes of the Statetof Washington and the ordinances of the City of Yakima. Section 8. This ordinance is one relating to local improvements or assess- ments therefor, and shall become effective immediately upon its passage, approval and publication as provided by the City Charter.
