AN ORDINANCE providing for the acquisition by condemnation or purchase of certain real v `
property more particularly described below, for use by the City of Yakima
as a disposal site for industrial wastes; "providing for the method of pay-
ment therefor; and declaring an emergency.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. That it is necessary that the City of Yakima, Washington, acq-
uire title by condemnation proceedings or purchase to all or a portion of the following
described real property situate in Yakima County, Washington, to -wit:
Tract 1: That portion of the E. 250.57 of Tract - 25 of Goodwins Five Acre Tracts lying
southerly of Secondary State Highway No. 11 -A, Yakima River Bridge Approach,
as shown on map now on file in the office of the Director of Highways at Oly-
mpia, Washington, and bearing date of approval July 31, 1956; containing 1.52
acres, more or less.
Tract 2: That portion of the NW4 of the SW4 of Section 28- 13 -19, lying westerly of the
Yakima River and southerly of Secondary State Highway No. 11 -A, Yakima River
Bridge Approach as shown on map now on file in the office of the Director of
Highways at 013rmpia, Washington and bearing date of approval July 31, 1956,
EXCEPT the 'W 60 of the N. 708.4' , and EXCEPT TIE W. 400 of the S 150,E of
the N. 858.4' and SUBJECT to easement to the U.S.: containing 31 acres, more
or less.
Tract 3: That portion of the SW4 of the SW4 of Section 28 -13 -19 lying westerly of the
Yakima River EXCEPT a 40 strip beginning at the NW corner of said subdivision
and extending S 42 E 681 to the Yakima River; and SUBJECT TO easement to
the U.S.;containing 15 acres, more or less.
Tract 4: The E. 250.57 of Tract 32 of Goodwins Five Tracts: containing 1.75 acres, more
or less.
Tract 5: The E. 250.57' of the Ni and all of the S a of Tract 33 of Goodwins Five Acre
Tracts, SUBJECT to easement to the U.S.; containing 3.37 acres, more or less.
Tract 6: Lot 40 of Goodwins Five Acre Tracts, together with easement to the U.S.; con-

taining 5 acres, more or less.
Tract 7s The S 2 of the SE4 of the SE4 of Section 29 -13 -19 EXCEPT the W. 200'; and SUB-
JECT to easement to the U.S.: containing 17 acres, more or less.
That the acquisition of said property is for the purpose of using same as a
disposal site for industrial wastes originating within the City of Yakima and conveyed
to said site by a separate industrial wastes sewer. It is hereby ordained that title to
all or a portion of the said real property above described be acquired by purchase or
condemnation proceedings as provided by law for the acquisition of property for such
public use.
Section 2. That the City Commission specifically finds that the land described
hereinis necessary for the proper development of an industrial wastes disposal site, and
that such improvement and the acquisition of the land therefor is hereby declared to be
a public use.
Section 3. That the cost and expense of acquisition of said real property
shall be determined in the manner provided by law; and all of such costs and the
of just compensation for said real property and severance damages, if any, done to a ad-
joining property by the acquisition of said real property, as determined by any
ings for such acquisition, should be y City proceed-,
paid for from any general funds of the City appli-
cable thereto.

Section 4. This ordinance is one to provide for the immediate preservation of
the public peace, property, health and safety, and an emergency is declared to exist,
and this ordinance shall be in full force and effect immediately upon its passage, app-
roval, and publication as provided by law and the City Charter.
PASSED BY THE CITY COMMISSION, signed and approved this 23rd day of September,
1957.
