B -2076 AN ORDINANCE establishing industrial wastes sewer charges, providing for the method of payment thereof, and providing for the measurement of said industrial wastes, and declaring an emergency. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. From and after June 1, 1958, there is hereby charged to all users of the industrial wastes sewer line and treatment facilities an annual service charge in an amount sufficient to amortize the actual costs to the City of Yakima for the construc- tion of the separate industrial wastes sewer, plus the necessary annual operation and maintenance costs of the separate industrial wastes system. Section 2. That said actual construction costs shall be as determined by the City Engineer after construction of the facilities.. This amount shall be multiplied by the factor 0.06505 (Capital Recovery Factor - 30 years at 5 per cent per annum) to determine said annual charge. Section 3. .Each user is hereby required to install a measuring device satis- factory to the City Engineer, to measure and record the liquid wastes contributed to the industrial sewer. The City Water Department shall have access to said measuring devices and shall take readings at periodic intervals. The Total yearly charge shall be apport- ioned among the users directly in proportion to the total volume of wastes contributed during the previous calendar year. The sewerage charge provided in this ordinance shall be payable at the office of the City Treasurer at the same time as the water bill for the premises is payable, and the yearly charge shall be paid in twelve equal monthly install- ments. Section 4. This industrial sewerage system is for industrial usage only and all sanitary facilities shall be discharged into a sanitary sewer and charged accordingly. Section 5. Where sewerage is provided to premises outside the city limits, the sewerage charge shall be computed on the same basis as premises located inside the city, except that a surcharge of fifty per cent (50%) shall be added. Section 6. All sewer charges shall be due and payable at the office of the City Treasurer on or before the 10th day after bill have been issued, and if unpaid shall become delinquent after said 10th day, and said date of delinquency shall be indicated on said bill, Any sewer service sharge which becomes delinquent shall immediately become a lien upon the premises, and if unpaid for sixty (60) days after delinquency, shall bear interest at the rate of 8% per annum, and such lien may be foreclosed by the City as pro- vided by state law. Said lien shall be superior to all other liens and encumbrances exce- pt general taxes and local and special assessments. Section 7. As an additional and concurrent method of collection of any such delinquent sewerage rate or charge, the water superintendent may cut off the water service or supply from the premises to which such rate or .charge for sewerage has attached until such rates and charges are paid. Section 8. Any and all revenues received for the use of this industrial sew- erage system, or in connection therewith, shall oe credited to`the Water -Sewer Fund, and all expenses for the operation and maintenance and for the servicing of bonds of said in- dustrial sewerage system shall be charged to said fund in the manner and to the extent provided by ordinance. Such expenses shall include the cost of billing and collection of said charges. Section 9. This Ordinance is one to provide for the immediate preservation of the public peace, property, health and safety, and an emergency is declared to exist, and this ordinance shall be in full force and effect immediately upon its passage, appro- val and publiC as provided by law and the City Charter.
