HomeMy WebLinkAbout1957-B-2066 r5g ORDINANCE NO., B -2066 AN ORDINANCE providing for the improvement of property in the City of Yakima, Washington by the construction of an irrigation system, establishing a Local Improvement District, providing for the method of payment, and creating a special fund. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. That property in the City of Yakima, Washington; shall be impro- ved by the construction of an irrigation system with the necessary mains, laterals, serv- ice connections and other appurtenances for the purpose of delivering water for irrigation purposes to each lot and tract within the proposed district; said improvements to serve the following described property: Lots 1 to 9 inclusive of Replat of •North Terrace Addition; Lots 27 to 32 inclusive of North Terrace Addition; Lots 1 to 4 inclusive of Conrad Addition; Also the SW2, NW2, NW2 of Section 36- 13 -18, which includes Lots 1 to.38 of the Swan Tracts and a portion of Block 9 of the Plat of Section 36 -13 -18 all of said improvement to be constructed in full ae cordance with .the plans and specifi- cations prepared or to be prepared by the City Engineer. Section 2. There is hereby created and established a local improvement dist- rict to be called "Local Improvement District No. 857 ", wbich said district shall include all of the property described and set forth in Section 1 hereof. , Section 3. All of the cost and expenses of said improvement, including the cost of acquiring right of way easements, engineering, surveying, advertising, publicat- ion of noticesm and any other expenses incident thereto shall be levied and assessed a- gainst the above described property as provided by law, all in accordance with the data and information theretofore submitted and filed with the City Commission of the City of Yakima by the City Engineer as required by law. Section 4. All of the work necessary to be done in connection with the mak- ing of said improvement shall be done by the City of Yakima. - Section 5. There is hereby created a special fund to be called "Local Imp- rovement Fund, District No. 857 ", which shall be paid all sums paid on account of the aforementioned special assessment, including all interest and penalties thereon; and in the event of the sale of local improvement bonds by this city, all premiums and interest on said bonds issued fcr said improvement. Section 6. Bonds bearing interest at the rate of 4% per annum, payable on or before 12 years from date of issuance shall be issued in payment of the costs and ex- penses of the said improvement, which bonds shall be redeemed by the collection of spec- ial assessments to be levied and assessed upon the property within the said district, pay- able in "12 annual installments, with Interest at the rate of 4% per annum, interest pay- able annually under the mode of "payment by bonds" as defined by the statutes of the State of Washington and the ordinances of the City of Yakima. Section 7. This ordinance is one relating to local improvements or assess- ments therefor, and shall become effective immediately upon its passage, approval and publication as provided by the City Charter.
