ORDINANCE NO. B -2061

AN ORDINANCE relating to parking of vehicles in the area between the curb and the property
line; regulating size, location, and construction of parking surfaces within
this area; providing a penalty for the violation of this ordinance and re-
pealing all ordinances and parts of ordinances in conflict herewith.
BE IT ORDAINED BY THE C ITY OF YAKIMA :
Section 1. Definition. This ordinance refers to vehicle parking, either
parallel or diagonal, iri the area between the curb line and the property line in any pub-
lic street right of *ay. Par king areas created in this area shall not be considered as
"off street" parking.
Section 2. Permit Required. No person, firm, or corporation shall remove
or alter any curb, or grade and surface any parking area as herein defined, without first
obtaining a permit therefor, All permits issued under the authority of this ordinance
shall be issued by the Building Inspector, and the charge for same shall be $ 2.50 for
each permit. As a condition precedent to obtaining such permit the applicant shall file
with the Building Inspector, for his approval, two copies of a drawing showing the loca-
tion and size of all such proposed improvements to serve the property affected.
Section 3. Prohibited Locations. Construction of park strip parking zones
shall be prohibited in the following locations: -
a. Adjacent to any designated arterial.
b. Within the area bounded by Naches Avenue on the East; Walnut Street on
the South; 6th avenue on the West; and "C" Street on the North. The area aforementioned
shall be measured from the center lines of said named streets.
Section 4. Construction Details.
a. A standard concrete sidewalk of 4 feet or more in width must be in place
between the, parking area and the property line. The grade and location of said walk must
be approved by the City Engineer.
b. A driveway type curb shall be created to give access to the area.
c. A 6" barrier curb of concrete shall be placed to prevent parked cars
from obstructing the sidewalk usage.
d. The parking area must be hard surfaced with concrete or asphalt to pre-
vent loose rock or dirt from being carried onto the paved street.
e. Alterations to the curb may not disrupt the existing drainage pattern.
f. The following minimum widths must be available between the curb and side-
walk for each of the listed types of parking:
Parallel 8'
Diagonal 12'
Perpendicular 16'
g. No curb cuts for access to parking areas may be created in locations
where driveways are prohibited under Ordinance No. B -1996.
h. The allowable length of curb cut for access to a parking area shall be
determined by the Building Inspector or the City Engineer.
Section 5. Public Property. The parking areas defined in this ordinance are
in the public right of way and use of such area must be surrendered to the public when
the area is required for street widening or when use of the area for parking creates a
hazard to the public health or safety.
Section 6. Saving Clause. If any section or part thereof of this ordinance
shall be held illegal, unconstitutional, or void, this shall not be construed to render
void any other provision or requirement of this ordinance.
Section 7. Penalties. Any person, firm or corporation violating any of the
provisions of this ordinance, or causing, permitting or suffering the same to be done,
shall be guilty of a misdemeanor and upon conviction shall be fined not more than One
Hundred Dollars ($100;00). Each such person, firm or corporation shall be deemed guilty
of a separate offense for each and every day or portion thereof during which any violation
of any of the provisions of this ordinance is committed, continued or permitted.
Section 8. Repeals. All ordinances or parts of ordinances of this City in
conflict herewith are hereby repealed.
Section 9. This ordinance shall be in full force and effect 30 days after
its passage, approval, and publication as provided by law and the City Charter.
