B -2057 AN ORDINANCE relating to animals or fowls at large, or found, in the City of Yakima, con- trary to any ordinance of the City of Yakima; providing for the taking up, impounding, keeping, and disposition of such animals or fowls; fixing the charges therefor and the disposition of money received in connection there- with; providing for a Humane Shelter and maintenance thereof by the Yakima County Humane Society; appointing a Poundmaster under Ordinance No. A -268 as amended by Ordinance No. B -327; declaring certain practices of certain ani- mals to be public nuisances, defining offenses and prescribing penalties, and repealing all other ordinances and parts of ordinances in conflict here- with. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The Yakima County Humane Society, a corporation, existing under Section 16.52.020 Revised Code of Washington, be and is hereby appointed as and declared to be the official poundmaster of the City of Yakima, and said corporation shall do all impounding of animals prescribed by ordinance. Section 2. The Yakima County Humane Society shall receive for its services as such 100% of all money collexted for dog and animal license fees and 10C% of all money collected for dangerous animal permits and for such impounding, and for care and feed for dogs, cats and other animals impounded. The City of Yakima shall sell the dog licenses provided for by Ordinance No. A -268 as amended; and all monies received by-the Yakima County Humane Society, its agents or employees, for dog licenses shall be paid to the City Treasurer of the City of Yakima within forty -eight hours from the receipt thereof. The City Treasurer is directed to pay on or before the 15th day of each calendar month to said Humane Society by warrant the sums provided and received by the city for such purpose during the preceding calendar month. Section 3. Said corporation as poundmaster shall provide adequate service 24 hours a day, seven days a week for the entire calendar year, and shall supply all necessary facilities, including a "Humane Shelter ", equipment and supplies together with the requisite number of employees to adequately perform its duties. Section 4. Each employee of such poundmaster over the age of 21 years, ex- cept clerks and stenographers, is hereby made a special police officer, shall be sworn in as such and shall be charged with the duty of enforcing this and all other ordinances of the city relating to the care, treatment or impounding of animals. Section 5. The poundmaster shall impound in the Humane Shelter all animals subject to impounding. The poundmaster shall collect and dispose of all dead animals found in the City and if the owner is known a fee of $ 1.00 may be collected therefrom for such. service. All sick or injured animals shall be impounded when not in the owner's possession and may be humanely destroyed at the discretion of the poundmaster. Any stray animals found may be detained at the 4umane Shelter until the owner or other person pro- ves his right to same to the satisfaction of the poundmaster, subject to payment of pen- alty, fees and costs as herein provided. Any dog, cat or other animal requiring a license found running at large without a valid license tag attached is declared to be a public nuisance and shall be impounded. The owner or keeper of any such impounded animal may redeem same within 72 hours upon payment of license fee and an impounding fee of 01.50, and beginning at 1 :00 A.M. of day after impounding a fee of $ 1.00 per day or part there- of for care and feed as may be accrued provided such animal is not suffering from serious injury or disease. The charge for boarding a dog shall be one dollar per day. Any animal impounded for want of a license tag, not redeemed as above pro- vided shall be humanely destroyed, or in the discretion of the poundmaster, may be held for a longer period and any person, upon approval of poundmaster may obtain such animal upon payment of licence fee and other accrued charges as provided herein. The pound - master shall keep a re.ord of all animals handled under this section, with description, dates and charges imposed. Section 6. It is unlawful to permit any animal not subject to license, or any reptile or fowl to run at large, or to permit any female dog or cat to run at large while in heat whether or not license tag is actached. It is unlawful to hinder, delay or obstruct the impounding of any animal, reptile or fowl. Section 7. Anyone having in his possession any animal, not owned by him, without the consent of the lawful owner or custodian, shall immediately notify the pound - master and release said animal to him on demand without charge. Section 8. It shall be unlawful to keep any dangerous or potentially danger- ous animal, reptile or fowl without written permit from the poundmaster revokable at its will and no such permit shall be issued unless such animal is properly secured from es- cape. The fee for such permit shall be $ 2.00 collectible by the poundmaster, and shall expire on December 31 of the year issued unless sooner revoked. Nothing herein shall be construed to exonerate anyone from liability that may accrue from keeping any such animal reptile or fowl whether under permit or not The poundmaster or any police officer may seize, impound or destroy any such animal, reptile or fowl running at large and the pound - master may detain the same until the owner or other person has substantiated his right of possession to the satisfaction of the poundmaster and makes claim, subject to payment of penalty, fees and costs herein provided for impounding. Section 9. The poundmaster shall be entitled to a fee of not to exceed ;1.50 for each day or part thereof any animal, reptile or fowl other than a dog or cat is de- tained and to an impounding fee of $ 2 which dhall include care and feeding for the day impounded. An additional fee of $ 7.50 shall be paid the poundmaster for transporta- tion of larger animals requiring the use of special equipment for impounding. Section 10. At any time after any horse, mule, cattle, hog, or other stock animal shall have been impounded because found loose within the city limits, the Yakima County Humane Society shall follow the procedure set out in the state laws relative to the care and sale of estrays. Section 11. It shall be unlawful to permit any vicious dog or dangerous animal to go unrestrained. 549 Section 12. It shall be unlawful to suffer or permit any animal, reptile or fowl totrespass on private or public property so as to damage or destroy any property or thing of value and same is hereby declared to be a nuisance and any such animal, reptile or fowl may be impounded by the poundmaster. Whenever it shall be affirmed in writing by 3 or more persons having separate residences, or regularly employed in the neighborhood that any animal, reptile or fowl is an havitual nuisance by reason of trespassing, howling barking, or other noise, or damage to property, being vicious or by its actions potentia- lly vicious or in any other manner causing undue annoyance, the poundmaster if he finds such nuisance to exist in fact, shall serve notice upon the owner or custodian that such nuisance must be abated within 48 hours, after which the poundmaster shall decide whether such nuisance has been abated and if not, any such animal shall be impounded. Refusal to release to the poundmaster any such animal, reptile or fowl shall constitute a violation of this ordinance. Section 13. If shall be unlawful to permit any dog or other animal whether licensed or not to run at large in any park, or to enter any public beach, pond, fountain or stream therein, or upon any public playground or school ground; or to tie or tether any animal on any street or public place or any unenclosed lot or premises in such manner as to permit such animal to enter any sidewalk, street, alley or other public place or up- on any adjoining lot or premises. Section 14. The City of Yakima shall not in any manner be liable by reason of any act or acts done by the Yakima County Humane Society, or any of its officers or employees, whether in the performance of the duties prescribed by this ordinance, or otherwise. Section 15. All privileges conferred upon the said Yakima County Humane Society under the provisions of this ordinance are subject to cancellation and revocation by the City Commission at any time, upon its own motion and without cause shown, which revocation and cancellation shall be declared by the passage of an ordinance repealing this ordinance; and all rights and privileges conferred hereunder shall cease and termin- ate thirty days after the passage of such repealing ordinance. Section 16. The Yakima County Humane Society shall, within thirty days after the passage of this ordinance, file with the Clerk of the City of Yakima, its written consent to the terms and provisions of this ordinance; otherwise, all rights and privileges hereunder granted shall be absolutely null and void, and this ordinance shall be of no force or effect. Section 17. Should any part of this ordinance be adjudged invalid for any reason, such adjudication shall not affect the validity of this ordinance as a whole or any other part thereof. Section 18. The violation of or failure to comply with any of the provisions of this ordinance shall be punishable by a fine not exceeding $ 300.00 or by imprisonment in the City Jail for a term not exceeding 90 days, or by both such fine and imprisonment. Section 19. This ordinance shall go into effect and be in force 30 days from and after its passage, approval and publication in accordance with the provisions of the City Charter, and it shall be retro- active in operation as of January 1, 1957.
