B -2020 AN ORDINANCE relating to off- street parking, and amending Section 15 of Zoning Ordinance No. B -293 entitled "An ordinance regulating and restricting the location of trades and industries; regulating and limiting the use of buildings and pre- mises; and the height and size of building; providing for yards, courts and other open spaces; establishing districts for such purposes, and providing for a board of adjustment, and repealing ordinance Nos. B -22, B -35, B -43, B -51, B -71, B -126, B -134, B -147, and B- 172 "; defining the downtown business district; providing for minimum parking space requirements for new build ings or structures or additions thereto within the City of Yakima; provid- ing for loading space requirements; defining gross floor area and prescrib- ing regulations for off - street parking; repealing Ordinance Nos. B -1738, B- 1811, B -1875, and B -1949. WHEREAS, the passage of this ordinance has been recommended by the City Planning Commission by reason of the increased congestion of vehicular traffic within the City and the lack of adequate off- street parking facilities, NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. Section 15 of Zoning Ordinance No. B -293, passed on March 28, 1938, entitled as shown in the caption hereof, as amended, as hereby amended by adding thereto at the end thereof two additional subsections to be designated "(g)" and "(h)" reading as follows: "(g) The downtown business district, defined in the official map of the "Downtown Business District" adopted asa.part of this ordinance is des- cribed as follows: "Beginning at the intersection of the center line of East "C "'Street and North leaches Avenue, thence south along the center line of Naches Avenue to the center line of East At Street, Hence east along the center line of East "A" Street to the centerline of the alley between North Naches Avenue and 6th Street, thence south along the center line of said alley to the center line of East Yakima Avenue, thence West along the centerline of East Yakima Avenue to Naches Avenue, thence south along the center line of South Naches Avenue to East Walnut Street, thence West along the center line of Walnut Street to the center line of 6th Avenue South, thence north along the center line of 6th Ave nue South to the center line of West Chestnut Street, thence West along the center line of West Chestnut Street to the center line of 10th Avenue South, thence north along the center line of 10th Avenue to the center line of Summitview Avenue, thence east along the center line of Summitview Avenue, to the center line of West Yakima Avenue, thence east along the center line of West Yakima Avenue to the center line of 5th Avenue, thence north along the center line of 5th Avenue to the center line of West "C" Street, thence east along the center line of "C" Street to the point of beginning" "(H) The following requirements shall be used to determine the adequacy of off street parking spaces: 1. DEFINITION OF PARKING SPACE: For the purpose of this section, two hund- red (200) square feet of lot or floor area, exclusive of aisles and /or driveways or internal moving lanes, having adequate access from a pub- lic thoroughfare shall be deemed a parking space for one (1) automobile. Parking facilities shall be arranged so as not to necessitate the use of any part of adjoining public sidewalks,parkways, roadways, boule- 11 vards, or thoroughfares in conducting parking or unparking operations. 2. LOADING SPACE REQUIREMENTS: An off- street leading space, having access to a public thoroughfare, shall be required adjacent to each business building hereafter erected, if the use of such building entails deliv- eries to it or shipments from it, and such loading space shall be of adequate size to accomodate the maximum number and size of vehicles sim- utaneously loaded or unloaded in connection with the business conducted in such guilding. No part of the truck or van using the loading space may project into the public thoroughfare. 3. DOWNTOWN BUSINESS DISTRICT EXEMPT: The Downtown Business District, as defined herein shall be exempt from the provisions of this sub- section. 4. MINIMUM PARKING SPACE REQUIREMENTS: For any new building, or structure, or addition thereto, hereafter erected within the City of Yakima, there shall be established and maintained a permanent, dust free, off - street parking area within five hundred (500) feet of the building or structure. Such distance shall be the walking,distance measured from the nearest point of the parking facility to the nearest point of the building or structure that such facility is required to serve. The capacity of such parking area shall be as follows, for the following uses: Multiple Dwellings 1 parking space for each dwelling unit Rooming and Lodging Houses, 1 parking space for each 3 occupants and Fraternity and Sorority Houses Hotels 2 spaces for each 3 bed±ooms Auto and Trailer Courts 1 parking space for each sleeping unit, and /or 1 parking space for each trailer space Hospitals, Sanitariums, 1 parking space for each 5 regular Convalescent Homes, Nursing beds plus 1 for every two employees Homes and Rest Homes with a minimum of two spaces 506 ORDINANCE NO. B -2020 Churches, Mortuaries, 1 parking space for each. 5 seats in Funeral Homes the Chapel or Nave Stadiums, Sports arenas, 1 parking space for each 5 seats Auditoriums, and other places of assembly with fixed seats Dance Halls, Exhibition Halls, 1 parking space for each 75 square and other places of assembly feet of gross floor area without fixed seats Skating Rinks and other 1 parking space for each 160 square commercial recreation places feet of gross floor area Bowling Alleys 5 parking spaces for each alley Schools Elementary & Jr. High 1 parking space for each employee Senior High School 2 parking spaces for each employee Colleges 3 parking spaces for each employee Theatres 1 M parking space for each six seats Medical and Dental Clinics 1 parking space for each square feet of gross floor area Banks, Business & Professional 1 parking space for each 200 square offices feet of gross floor area Restaurants, Taverns, and 1 parking space for each. 100 square any establishment for the feet of gross floor area sale and consumption on the premises of food, alcoholic beverages or refreshments Retail Stores, except as otherwise specified: Having not more than 7 000 1 parking space for each 300 square square feet of gross floor ,area feet of gross floor area Having more than 7000 square 1 parking space for each 150 square feet of gross floor area feet of gross floor area in excess of 7000 square feet Furniture, Appliance, 1 parking space for each 600 square Hardware and clothing feet of gross floor area stores, service or personal service shops Wholesale stores, warehouses 1 parking space for each 2 employees and storage buildings, motor vehicle or machinery sales Manufacturing uses in luding 1 parking space for each 3 employees Research and Testing Labor- based on the maximum working shift. atories, Creameries, Soft Drink Bottling E Bakeries, Canneries, Printing and Engraving Shops 5. UNSPECIFIED USES: In the case of a use not specifically mentioned in this section, the requirements for off- street parking facilities shall be the same as for the above mentioned uses which, in the opinion of the Build- ing Inspector, shall be deemed most similar. 6. MIXED OCCUPANCIES: In the case of mixed uses, the total requirements for off - street parking facilities shall be the sum of the requirements for the various uses computed separately. Off- street parking facilities for one use shall not be considered as providing required parking facilities for any other use, except as hereinafter specified for cooperative use. 7. COOPERATIVE PROVISION: Nothing in this section shall be construed to pre- vent cooperative provision of off- street parking facilities for two or more buildings or uses, provided that the total of such off- street park- ing spaces supplied cooperatively shall not be less than the sum of the requirements for the various uses agmputed separately. None of the above provisions shall prevent the over - lapping cooperative use of parking fac- ilities when the times during which such facilities are used are not con- flicting. 8. BUILDING PERMITS: Before the granting of a building permit for any new building or structure, or for any enlargement or change of use in any building hereafter constructed, involved in any of the aforementioned uses, the applicant for said building permit shall present satisfactory evidence that arrangements have been made to provide off- street parking in accordance with the provisions of this section. 50 ORDINANCE NO. B -2020 . 9. DEFINITION OF GROSS FLOOR AREA: Gross floor area in the case of offices, merchandising or service types of uses shall mean the gross floor area used, or intended to be used, by tenants or for services to the public as customers, patrons, clients or patients, including area occupied by fixtures and equipment used for display or sale of merchandise. It shall not include area used principally for non - public purposes such as storage, incidental repair, processing or packaging of merchandise for show wind- ows, for offices incidental to the management or maintenance for offices incidental to the management. or maintenance of stores or buildings, for toilet or rest rooms, for utilities, or for dressing rooms, fitting or alteration rooms." Section 2. Ordinance Nos. B -1738, B -1811, B -1875, and B -1949 are hereby re- pealed. Section 3. This ordinance shall be in full force and effect 30 days after its passage, approval and publication as provided by law and the City Charter.
