ORDINANCE N.O. B -2018
AN ORDINANCE regulating and establishing building lines on officially designated arterial
streets as established in the traffic code.
- BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. No building permit shall be issued for any structure on land
located between the mapped lines (of2officially designated arterial streets as establish-
ed in the traffic code) as shown on the attached "official map ", •Engineer's Drawing No.
13 -65 which is incorporated herein by reference and made a part of this ordinance.
Section 2. It shall be the duty of the Building Inspector to enforce this
ordinance. In case of controversies between the Buidling Inspector and applicants for
permits, such controversies may be submitted to the Board of Adjustment, as created under
Ordinance B -293, and amended in Ordinance B -1448, which shall have the power to grant a
permit for a structure within the mapped lines of arterial streets if ,it finds (a) the
entire property of the landowner cannot produce a reasonable economic return unless such
a permit is granted, and (b) balancing the interests of the landowners and the City, the
grant of such a permit is required for reasons of justice and equity. In granting such
a permit the Board may specify the exact location of the building and the ground area it
may cover.
Appeals and procedures shall be as outlined in ordinance 5-1448.
Section 3. This ordinance is one relating to the peace, health, and safety
of the People of the City of Yakima, and an emergency exists therefor and the same shall
be in full force and effect from and after its passage, approval, and publication.
