B -2009 *UNDO @!r ONDtNANt R10 -2 /57- Ste- a• ; AN ORDINANCE establishing standards for the construction and maintenance of residential streets, curbs, gutters, and sidewalks, and for the maintenance thereof. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. That all construction and maintenance of residential streets, curbs and gutters, and sidewalks shall be under the supervision of the City Engineer and shall be done in accordance with the plans and specifications provided by said City Engineer. Section 2. That cement concrete pavement or asphaltic concrete pavement with cement concrete curbs and gutters shall be considered a permanent type of pavement, and the City will maintain it indefinitely. The minimum width, right of way permitting, ahall be 32 feet face to face of curbs. Section 3. That twoshot asphaltic penetration pavement, not including curbs and gutters, shall be considered as a stage in the ultimate development of the permanent type of pavement referred to in Section 2 hereinabove, and the City Will maintain it for a period of 5 years. As to such type of pavement, the minumum width, right of . way per- mitting, shall be 30 feet not including curbs and gutters. However, at such time as curbs and gutters are installed and there is added asphaltic concrete overlay, it shall be considered a permanent -type pavement, and in such event the City will maintain it in- definitely. Section 4. That the City assumes no responsibility for the construction or maintenance of residential streets, curbs and gutters, and sidewalks which do not comply with the standards set forth herei _ bov . 401111110110 0' OWQ)PoAts( ++L FvO.• 9" - S Section 5. That sidewalks, where installed, shall be constructed of cement concrete at least 4 feet in width and shall be located either adjacent to the curb or with the outer edge of the walk two feet from the property line, and all sidewalks shall be consistent in each block. 111 Section 6. That on new construction or improvements on officially design- ated arterial streets the property owners shall be assessed on the basis of a 32 -foot residential street. Additional costs due to excess width shall be,borne by the City. Section 7. That full right of way must be available before streets will be constructed, and the construction of half -width streets shall not be permitted. Section 8. That the attached Engineer's Drawing No. 13 -81 is incorporated herein by reference and made a part of this ordinance. Section 9. That this ordinance shall be in full force and effect 30 days after its final passage, approval and publication as provided by law and the City Charter.
