ORDINANCE B -1999
AN ORDINANCE providing for the improvement of property in the City of Yakima, Washing-
ton by the construction of an irrigation system, establishing a Local Im-
provement District, providing for the method of payment, and creating a
special fund.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1.- That property in the city of Yakima, shall be improved by the
construction of an irrigation system with the necessary mains, laterals, service con-
nections and other appurtenances for the- purpose of delivering water for irrigation
purposes to each lot and tract within the proposed district; said improvements to serve
the property the boundaries of which are described as follows:
Lots 2 to 33 inclusive of Westview Addition;
Lots 1 to 13 and 16 to 27s inclusive of Liebert Addition;
Blocks, 1, 2 and 3 of Rose Park;
Lots 1 to 18, inclusive of Petzel Addition;
Lots 1 to 40 of the unrecorded plat of Richards Half Acre Homes,
being the East 2 SE4 NE4 of Section 27- 13 -18;
The South 70 feet of the West 140 feet of the East 165 feet of the
W4 NE4 NE4 of Section 27- 13 -18; also the South 140 feet of the
North 170 feet of the East half of the NW4 NE4 NE4 of Section
27- 13 -18;
Also the SW4 NW4 NW4- of Section 36 -13 -18 which includes Lots 1 to
38 of the Swan Tracts and a portion of Block 9 of the Plat of
Section 36- 13 -18.
all of said improvements to be constructed in full accordance with the plans and spec-
ifications prepared or to be prepared by the City Engineer.

- Section 2. There is hereby created and established a local improvement
district t� be called "Local Improverent District No. 852 ", which said district shall
include all of the property described and set forth in Section 1 hereof. -
Section 3. All of the cost and expenses of said improvement, including tle
cost of acquiring the right of way easements, engineering, surveying, advertising, pub-
lication of notices, and any other expenses incident thereto shall be leviedand assessed
against the above described property as provided by law,, except that the Irrigation
Maintenance Fund will pay $2200.00 as a portion of the cost of the main line extending
from the Yakima Valley Canal Southerly to Westview Addition; all in accordance with the
data and information heretofore submitted and filed with the City Commission of the
City of Yakima by the City Engineer as required by law.
Section 4. All of the work necessary to be done in connection with the
making of said improvement shall be done by the City of Yakima.
Section 5. There is hereby created a special fund to be called "Local
Improvement Fund, District No. 852 ", into which shall be paid all sums • paid on account
of the aforementioned special assessment, including all interest and penalties there-
on; and in the event of the sale of local improvement bonds by this City, all premiums
and interest on said bonds issued for said improvement.
Section 6. Bonds bearing interest at the rate of 4% per annum, payable
on or before 12 years from date of issuance shall be issued in payment of the costs
and expenses of the said improvement, which bonds shall be redeemed by the collection
of special assessments to be levied and assessed upon the property within the said
district, payable in 10 annual installments, with interest at the rate of 4% per annum,
interest payable annually under the mode of "payment by bonds" as defined by the stat-
utes of the State of Washington and the ordinances of the City of Yakima.
Section 7. This ordinance is one relating to local improvements or - ass'es-
sments therefor, and shall b ecome effective immediately upon its passage, approval and
publication as provided by the City Charter.
