AN ORDINANCE providing for the improvement of property in the City of Yakira , . Wash-
ington by the construction of an irrigation system, establishing a Local
I District, providing for the method of payment, and creating
a special fund.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. That property in the city of Yakima, Washington, shall be
improved by the construction of an irrigation system viL th the necessary mains, laterals,
service connections and other appurtenances for the purpose of delivering water for
irrigation purposes to each lot and tract within the proposed district; said improve-
ments to, serve the property the boundaries of which are described as follows:
The East half of the Northwest Quarter, Southeast Quarter, Southeast
Quarter, of Section 22, Township 13, North., Range 18, E.W.M., except
the South 65 feet of the North 90 feet of t he West 135.9 feet of the
East 162.5 feet and except the right -of -way for streets. Also, lots
1 to 14 of Heyduck Park Addition No. -2• .
all of said improvements to be constructed in full accordance with the plans and
specifications prepared or to be prepared by ;the City Engineer.
Section 2,. There is hereby created and established• a local improvement
district to be called "Local I District No. 851," which said district shall
include all of the property described and set forth in Section 1 hereof.
Section 3. All of the cost and expenses of said improvement, including
the cost of acquiring right of way easements, engineering, surveying, advertising,
publication of notices, and any other expenses incident thereto shall be levied
and assessed against the above described property as provided by law, in accordance
with the data and information heretofore submitted and filed with the City Commission
of the City of Yakima by the City Engineer as required by law. c.

Section 4. All of the work necessary to be done in connection with the
making of said improvement shall be done by the City of Yakima.
Section 5. There is hereby created a special fund to be called "Local
Improvement Fund, District No. 851, " into which shall be paid all sums paid on account
of the aforementioned special assessment, including all interest and penalties thereon;
and in the event of the sale of local improvement bonds by this City, all premiums
and interest on said bonds issued for said improvement.
Section 6. Bonds bearing interest at the rate of 4% per annum, payable
on or before 12 years from date of issuance shall be issued in payment of the costs
and expenses of the said improvement, which bonds shall be redeemed by the collection
of special assessments to b e levied and assessed upon the property within the said
district, payable in 10 annual installments, with interest at the rate of 4% per- annum,
interest payable annually under the mode of "payment by bonds " as defined by the
statutes of the State ; of .Washington and the ordinances of the City of Yakima.
Section 7. This ordinance is one relating to local improvements or
assessments therefor, and shall become effective immediately upon its passage, approval
and publication as provided by the City Charter.
PASSED BY THE CITY COMMISSION, signed and approved this 26th day of
November, 1956.
