ORDINANCE NO. B- 1958 -A
AN ORDINANCE providing for the improvement of property in the City of Yakima by the
. construction of necessary mains, fire hydrants, valves and other appurt-
enances for the purpose of supplying water for domestic use and fire
protection, establishing a Local Improvement Distri providing for the
• method of payment therefore, and creating a special fund;
BE IT ORDAINED BY THE CITY,OF YAKIMA:
Section 1. That property in the City of Yakima, Washington, shall be
improved by the construction of necessary mains, fire hydrants, valves. and other
appurtenances for the purpose of supplying water for domestic use and fire protection;.
said improvement to serve the property the boundaries of which are described as followq
All of Tract 56 and the South 125 feet of Tract 65 of First Addition to
Suburban Acre Homes;
• Also.,.the Ni, E2, Si, Si; NE4 NE4 of Section 35, Township 13, North,
Range 18, E.W.M.
All of said improvement to be constructed in full accordance with the '
plans and to be prepared by the City Engineer.
Section 2.. There is hereby created and established.a Local Improvement
District, to be called "Local Improvement District No. 850" which said district shall
include all of the property described and set forth in Section 1 hereof.
Section 3. A portion of the cost ande xpenses of said improvement,
including the engineering, inspection, advertising, publication of notices, and.any
other expenses indicent thereto shall be levied and assessed againstthe above described
property as provided by . law, and the balance of said costs and expenses shall be borne
by the City Water Department; in accordance with the data and information heretofore
submitted and filed with. the City Commission of the .City of Yakima by the City Engineer
as required by law.
Section 4. All of the work necessary to be done in connection with the
making of said improvement shall be done by the City of Yakima. .
Section 5. There is hereby created a special fund to be called "Local
Improvement Fund, District No. 850" into which shall be paid all sums paid on account
of the aforementioned special assessment, including all interest and penalties. there-
on; and in : the event of the sale of local improvement bonds by this City, all premiums
and interest on said issued for said
Section 6. Bonds bearing interest at the rate of 4% per annum, payable •
on or before 10 years from date of issuance shall be issued in payment of the costs .
and expenses of the said improvement, which bonds shall be redeemed by the collection
of special ,. assessments to be levied and assessed upon the property within the said
district, payable in ten annual installments, with interest at the rate of 4% per
annum, interest payable annually under the mode of "payment by bonds" as defined b y
the statutes of the State of Washington and . the ordinances of the City of Yakima.
Section 7. This ordinance is one relating to local improvements or
assessments therefor, and shall become effective immediately upon its passage,
approval and publication as provided by the City charter.
