HomeMy WebLinkAbout1956-B-1943 x41.6 nRnTNf NnR NO- B- 190 AN ORDINANCE providing for the improvement of property in the City of Yakima by the construction of necessary mains, fire hydrants, valves and other appurten- ances for the purpose of supplying water for domestic use and fire protection establishing a Local Improvement District, providing for the method of pay- ment therefore, and creating a special fund; BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. That property in the City of Yakima, Washington, shall be improved by the construction of necessary mains, fire hydrants, valves and other appurt- enances for the purpose of supplying water for domestic use and fire protection; said improvement to serve the property the boundaries of which are described as follows: That part of WW, El Ei, NE*, SW* lying South of the Yakima Valley Canal Co., all within Section 22, Township 13 North, Range 18 E.W.M. Also, beginning at a point 325' N. and 130.2' W. of the S.E. corner of SW* of Section 22, Township 13 North, Range 18, E.W.M.; thence E..148.8; thence N. 105 thence E. 82.2 thence N. 202.63'; thence W. 230.2 thence S. 307.76 to the point of beginning. all of said improvement to be constructed in full accordance with the plans and specific- ations to be prepared by the City Engineer. Section 2. There is hereby created and established a Local Improvement District, to be called "Local Improvement District No. 846f which said district shall include all of the property described and set forth in Section 1 hereof. Section 3. A portion of the cost and expenses of said improvement, estimat- ed by the City Engineer to be approximately $14,416.45, including the cost of acquiring right of way easements, engineering, surveying, advertising inspection, publication of notices and other expenses incident thereto, shall be levied and assessed upon all of the property embraced within said Local Improvement District, in accordance with the special benefits conferred thereon, in the manner provided by the laws of the State of Washington and the ordinances of the City of Yakima; and the balance of the cost shall be borne by the City Water Department. Section 4. All of the work necessary to be done in connection with the making of said improvement shall be done by the City of Yakima. Section 5. There is hereby created a special fund, to be called "Local Improvement Fund, District No. 846 ", into which shall be paid all sums paid on account of the aforementioned special assessment, including all interest and penalties thereon; and in the event of the sale of Local Improvement Bonds by the city, all premiums and interest on said bonds, issued for said improvement. Section 6. Bonds bearing interest at the rate of 4% per annum payable on or before 12 years from date of issuance, shall be issued in payment of the cost and • expenses of said improvement; which bonds shall be redeemed by the collection of special assessments to be levied and assessed upon the property within said district, payable in 10 equal annual installments with interest at the rate of 4% per annum interest payable annually, under the mode of "Payment by Bonds ", as defined by the statutes of the State of Washington and the ordinances of the City of Yakima. Section 7. This ordinance is one relating to Local Improvements or assessments therefor, and shall become effective immediately upon its passage, approval, and publication as provided by the City Charter.
