ORDINANCE NO. B -1937
AN ORDINANCE providing for the improvement of property in the City of Yakima by construct-
ion of a sewer system, establishing a local improvement district, providing
for the method of payment therefore, and creating a special fund.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. That property in the City of Yakima, Washington, shall be
improved by the construction of a sewer system with the necessary wye branches, manholes
and lampholes for the purpose of providing a sewage system; said improvement to serve
the property the boundaries of which are described as follows:
All of Westover Terrace Addition -
That part of Wi, E2, E2, NEw, SW, lying South of the Yakima Valley Canal
Co. R/W except for Chestnut Street.
Also, Beginning at a point 325' N. and 130.2' W. of SE corner of SW
of Section.22, Township 13 North, Range 1$, E.W.M.; thence E. 14$.$';
thence N. 105'; thence E. $2.2'; thence N. 202.63'; thence W. 230.2';
thence S. 307.76' to the point of beginning
all of said improvement to be constructed in full accordance with the plans and specif-
ications to be prepared by the City Engineer.
Section 2. There is hereby created and established a Local Improvement
District, to be called "Local Improvement District No. $45 11 which said district shall
include all of the property described and set forth in Section 1 hereof.
Section 3. A portion of the cost and expense of said improvement, estimate'
by the City Engineer to be approximately $16,470.73, including the cost of acquiring
right of way easements, engineering, surveying, advertising, inspection, publication of
notices and other expenses incident thereto, shall be levied and assessed upon all of th
property embraced within said Local Improvement District, in accordance with the special
benefits conferred thereon, in the manner provided by the laws of the State of Washingto
and the ordinances of the City of Yakima; and the balance of the cost of the main to
serve this district shall be borne by the City Sewer Fund.
Section 4. All of the work necessary to be done in connection with the
making of said improvement shall be done by the City of Yakima.
Section 5. There is hereby created a special fund, to be called "Local
Improvement Fund, District No. $45," into which shall be paid all sums paid on account
of the aforementioned special assessment, including all interest and penalties thereon;
and in the event of the sale of Local Improvement Bonds by the city, all premiums and .
interest on said bonds issued for said improvement.
Section 6. Bonds bearing interest at the rate of 4% per annum payable on
or before 12 years from date of issuance, shall be issued in payment of the cost and
expense of said improvement; which bonds shall be redeemed by the collection of special
assessments to be levied and assessed upon the property within said district, payable in
ten equal_ annual installments with interest at the rate of 4% per annum interest payable
annually, under the mode of "Payment by Bonds ", as defined by the statutes of the State
of Washington and the ordinances of the City of Yakima.
Section 7. This ordinance is one relating to Local Improvements or assess-
ments therefor, and shall become effective immediately upon its passage, approval,and
publication as provided by the City Charter.
