B -1876 AN ORDINANCE imposing a lien upon property for delinquent garbage collection service charges and amending subdivision (0) of Section 10, of Ordinance No. B -1523 entitled !'AN ORDINANCE relating to public health and sanitation; providing for an regulating the compulsory collection and disposal of garbage, refuse and dead animals in the City of Yakima; regulating the operation of the City Dump and collection service; creating a special fund and providing for the payment of monies Into said fund; providing penalties for the violation hereof; and repealing Ordinance No. B -1511 and all other ordinances and parts of ordinances-in conflict herewith ". BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. Subdivision (C) of Section 10 of Ordinance No. B -1523 is hereby amended to read as follows: "(C) The collection of all refuse in the Residential Classification shall be a service conducted by the City of Yakima equipment and personnel, and fi- nanced by a garbage and refuse collection fee; provided, however, that City service shall not be furnished to apartments and multiple units in excess of four units except upon request of the owner or operator thereof. As to apartments and multiple units served by a licensed collector, the collection of all refuse therefrom must be made by such licensed collector only. . "(1) There is hereby imposed for garbage and refuse collection service in �,�bk. — the residential classification, the following charges based on the number of residential units carried under the same account number and street address as ("` for Water Department metered services, and providing the garbage cans are centrally located together in one place: $1.00 for first residential unit per month . for second additional residential unit per month .50 for third additional residential unit per month .25 for any additional residential units per month which charges shall be paid bi- monthly to the Yakima City,Treasurer after such services are rendered, simultaneously with the water charges if any for such property. There is hereby imposed a further charge of 50¢ which shall be added to all accounts delinquent. Accounts shall become delinquent if not paid on or before the 10th day following "date of billing. There will be no discounts al- lowed on multiple units for vacancies, at this rate. All charges will be based on the total number of residential units in the apartment house or multiple dwelling that can be used for housekeeping purposes. "(2) Collection service may be suspended for non - payment of such accounts, but such suspension shall not relieve the person owing such account from the duty of complying with the provisions of this or other ordinances pertaining to garbage, refuse or sanitation. Such suspension of service shall render the pre- mises where such collection service is suspended subject to condemnation for lack of sanitary requirements;. and the owner or person in charge or possession of said premises shall be subject to prosecution for maintaining a nuisance upon said premises. "(3) The charges herein provided may be suspended by the City of Yakima upon written advance notice for a period of thirty (30) days or more, given to the Sanitation Department of an intention to vacate any premises. Prior to the resumption of occupancy of such vacated premises, notice must be given to' said Department, so that such collection service may be resumed. Applications for service shall be made at the office of the Sanitation Department upon printed forms to be provided by the Department, and shall contain the name of the person • receiving garbage collection service, street address of property, and the number of units served. 0 (4) Upon failure to pay such charges and upon delinquency the amount thereof shall become a lien against the property from-which the garbage collectial service shall have been rendered. Such lien shall be made effective by filing a notice thereof specifying the charges, the period covered by the charges and giving a legal description of the premises at which the service was rendered. Such lien shall be filed with the same official and within the time and shall be foreclosed within the time and manner prescribed by law for filing and fore- closing liens for labor and material. Such lien shall be prior to any and all other liens and encumbrances filed subsequent to the filing of such lien, but shall be subject to all general taxes and local improvement assessments, whether levied prior or subsequent thereto." Section 2. This ordinance shall be in full force and effect thirty (30) days after its passage, approval and publication as provided by law and the City Charter.
