ORDINANCE NO. B -1872
AN ORDINANCE providing for the improvement of certain property by grading,, - ballasting,
surfacing and constructing concrete curbs and gutters; establishing a Local
Improvement District, providing for the method of payment therefor, and
creating a special fund.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. That a portion of Swan Avenue shall be improved by grading.,
ballasting, surfacing and constructing concrete curbs and gutters together with the
necessary drainage features consisting of curb boxes, 8 inch pipe siphons and 175 lineal
feet, more or less, of 8 inch pipe drain, all of said improvements to be constructed in
full accordance with the plans and specifications to be prepared by the City Engineer,
and filed with the City Clerk. -The property to be benefited by this improvement consists
of the following:
Beginning at a point on the north line of Swan Avenue 147 feet east of the
east line of 16th Avenue North; thence north 150 feet; thence easterly to
a point on the east line of the Northeast quarter of the Southwest quarter
-of the Southwest quarter of Section 13, Township 13 North, Range 18 E.W.M.,
which is 90 feet north of the north line of Swan Avenue; thence south 240
feet to a point 90 feet south of the south line of Swan Avenue; thence
westerly and parallel with Swan Avenue to the center line of the Pacific
Power & Light Company's Canal; thence southwesterly along said center line
• to a point 139.7 feet south of the south line of Swan Avenue; thence wester-
ly and parallel with Swan Avenue to a point 147 feet east of the east line
of 16th Avenue South; thence north to the point of beginning, situate in
Yakima, Yakima County, Washington.
Section 2. There is hereby created a Local Improvement District to be
called Local Improvement District No. 840, which said district shall include all of the
property described and set forth in Section 1 hereof.
• Section 3. All of the cost and expense in connection with the making and
construction of said improvement, including the cost and expense of acquiring right -of-
way easements, engineering, inspection, advertising, publication of notices and all
other expenses incident .thereto, shall be levied and assessed upon all of the property
embraced within said Local Improvement District in accordance with the special benefits
conferred thereon in the manner provided by the laws of the State of Washington and the
ordinances of the City of Yakima, and said City shall not be liable in any manner for
any portion of said costs and expenses of said improvement.
Section 4. All of the aforesaid construction work shall be in accordance
with the plans, specifications, profiles, maps and detailed drawings which have been
prepared by the City Engineer, filed with the City Clerk and which are hereby approved
and adopted.
Section 5. All of the work necessary to be done in connection with the
making of said improvement shall be done and made by contract upon competitive bids; and
the City shall have the power to reject any and all bids.
Section 6. There is hereby created a special fund to be called "Local Im-
provement Fund, District No. 840 ", into which shall be placed all sums paid on account
of the aforesaid special assessment, including all interest and penalties thereon; and,
in the event of the sale of Local Improvement Bonds by the City, all premiums and inter-
est on said bonds issued for said improvement.
Section 7. Bonds bearing interest at the rate of 4% per annum, payable on
or before 12 years from the date of issuance, shall be issued in payment of the cost and
expense of said improvement; which bonds shall be redeemed by the collection of special
assessments to be levied and assessed upon the property within said district, payable in
10 equal annual installments with interest at the rate of 4% per annum, interest payable
annually, under the mode of "Payment by Bonds" as defined by the statutes of the State
of Washington, and the ordinances of the City of Yakima.
Section 8. This ordinance is one relating to local improvements or assess-
ments therefor, and shall become effective immediately upon its passage, approval and
publication as provided by the City Charter.
PASSED BY THE CITY COMMISSION, signed and approved this 23rd day of April,
1956.
