B -1869 AN ORDINANCE providing for the improvement of certain property by constructing a pipe • sewer with the necessary wye branches, manholes, flush tanks with water connections therefor; establishing a Local Improvement District, providing for the method of payment therefor; and creating a, special fund. BE IT ORDAINED -BY THE CITY OF YAKIMA: • Section 1. That the hereinafter described property in the City of Yakima, Washington, shall be improved by the construction of a pipe sewer with the necessary wye branches and manholes, and by doing such other work as may be necessary in connection therewith. Section 2. There is hereby created and established a Local Improvement District to be called "Local Improvement District No. 839 0 ,.which said district is de- scribed as follows: • Lots 1 to 27, inclusive, of Liebert Addition, and the South 70 feet of the West 140 feet of the East 165 feet of the West half of the Northeast quarter of the Northeast quarter of Section 27, Township 13 North, Range 18 E.W.M., Yakima,.Yakima County, Washington. Section 3. All of the costs and expenses in connection with the making and construction of said improvement, including the engineering, inspection, advertising, publication of notices, obtaining right -of -way easements and all other expenses incident thereto, shall be levied and assessed upon all of the property embraced within said Local Improvement District, in accordance with the special benefits conferred thereon, in the manner provided by the laws of the State of Washington, and the ordinances of the City of Yakima;.and the said city shall not be liable in any manner for any portion of said costs and expenses of said improvement. Section 4. All of the aforesaid construction shall be in full accordance with the plans, specifications, profiles, maps and detailed drawings, which have been prepared by the City Engineer, filed with the City Clerk, and which are hereby approved and adopted. 0 . Section 5. All-of the work necessary to be done in connection with the mak- ing of said improvement shall be done and made by contract upon competitive bids; and the.City of Yakima shall have and reserve the right to reject any and all bids. Section 6. There is- hereby created a special fund, to be called "Local Im- provement Fund, District No. 839 ", into which shall be paid all sums on account of the •aforementioned special assessment, including all interest and penalties thereon; and, in the event of the sale of Local Improvement Bonds by the city, all premiums and interest on said bonds issued for said. improvement. Section 7. Bonds bearing interest at the rate of 4% per annum, payable on or before 12 years from date of issuance, shall be issued in payment of the costs and expenses of said improvement; which bonds shall be redeemed by the collection of special • assessments to be levied and assessed upon the property within the said district, payable in 10 equal annual installments, with interest at the rate of 4% per annum., interest pay- able annually, under the mode of "Payment by Bonds" as defined by the statutes of the State of Washington and the ordinances of the City of Yakima. Section 8. This ordinance is one relating to local improvements or assess- . ments therefor, and shall become effective immediately upon its•passage, approval and publication as provided -by the city charter.
