B -1868 AN ORDINANCE providing for the improvement of property in the City of Yakima by con- struction of a domestic water system, establishing a local improvement di- strict, providing for the method of payment therefor, and creating a special fund. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. That the following described property in the City of Yakima, Washington, shall be improved by the construction of a domestic water system, with the necessary mains, valves and other appurtenances for the purpose of supplying water for domestic use; said improvement to serve the the boundaries of which are de- scribed as follows: The West 139 feet of Lots 1 to 4 inclusive of Burrows Suburban Tracts; The West 90 feet of Lots 5 & 6 of Burrows Suburban Tracts; The West 139 feet of the East half of the Southeast quarter of the South- west quarter of the Southeast quarter of Section 22, Township 13 North, Range 18 E.W.M.; All of said property situate in the City of Yakima, Yakima County, Washington; all of said improvement to be constructed in full accordance with the plans and. speci- fications to be prepared by the City Engineer. Section 2. There is hereby created and established a Local Improvement Di- strict to be called "Local. Improvement District No. 838" which said district shall in- clude all of the property described and set forth in Section 1 hereof. Section 3. A portion of the cost and expenses of said improvement including the cost of acquiring right of way easements, engineering, surveying, advertising, in- spection, publication of notices and other expenses incident thereto, the same being estimated by the City Engineer to be approximately $2483.03, shall be levied and assessed upon all of the property embraced within said Local Improvement District, in accordance with the special benefits conferred thereon, in the manner provided by the laws of the State of Washington and the ordinances of the City of Yakima; and the City Water Depart- ment shall pay the remainder of the cost and expense of said improvement, said portion being estimated by the City Engineer to be approximately the sum of $174.70, pursuant to segregation of said costs in accordance with Resolution No. C -1051, adopted on March 30, 1953• Section 4. All of the work necessary to be done in connection with the mak- ing of said improvement shall be done by the City of Yakima. Section 5. There is hereby cre hall be special "Local Im- provement Fund, District No. 838 ", into whit paid all sums paid on account of the aforementioned special assessment, including all interest and penalties thereon; and in the event of the sale of Local Improvement Bonds by the city, all premiums and inter- est on said bonds issued for said improvement. Section 6. Bonds bearing interest at the rate of 4% per annum, payable on or before 12 years from date of issuance, shall be issued in payment of the cost and ex- pense of said improvement; which•bonds shall be redeemed by the collection of special assessments to be levied and assessed upon the property within said district, payable in ten equal annual installments with interest at the rate of 4% per annum interest payable annually, under the mode of "Payment by Bonds" as defined by the statutes of the State of Washington and the ordinances of the City of Yakima. Section 7. This ordinance is one relating to local improvements or assess- ments therefor, and shall become effective immediately upon its passage, approval and publication as provided by the City Charter.
