B- 1858 -a AN ORDINANCE providing for the improvement of certain property by constructing a pipe sewer with the necessary wye branches, manholes and flush tank with water connections therefor; establishing a Local Improvement District, providing for the method of payment thereof, and creating a special fund. BE IT ORDAINED BY THE CITY OF YAKIMA: . Section 1. That the hereinafter described property in the City of Yakima, Washington, shall be improved by the construction of a pipe sewer with the necessary wye branches, manholes and flush tank with water connections therefor, and by doing such other work as may be necessary in connection therewith. Section 2. There is hereby created and established a Local Improvement District to be called "Local Improvement District No. 836 which said district is de- . scribed as follows: . All of Block 1 and 2 of Sutor Addition; Lots 21, 30 and 31 Suburban Acre Homes; . Lots 36 to L inclusive, First Addition to Suburban Acre Home.; Vacated Street adjacent to Lot 4O, First Addition to Suburban Acres Homes; Lots 59 to 63, inclusive, First Addition to Suburban Acre Homes; and the east 152 feet of the Southeast - quarter of the Southeast quarter of the Southwest quarter of the Southeast quarter of Section 26, Township 13 North, Range 18 E.W.M.; al of said district being situate in the City of Yakima, Yakima County, Washington. Section 3. Except as hereinafter stated, all of the costs and expenses in connection with the making and construction of said improvement, including the engin- eering, inspection, advertising, publication of notices, and all other expenses incident thereto, shall be levied and assessed against the above described property, in accord- ance with the special benefits conferred thereon, in the manner provided by the laws of . the State of Washington and the ordinances of the City of Yakima; and the said city shall not be liable in any manner for any portion of said costs and expenses of said im- provement, except that the City Sewer Fund is to bear the cost of the main in excess of that which would be required to serve this district, said amount to be borne by the City Sewer Fund being estimated at approximately X2000.00. Section 4. All of the aforesaid construction shall be in full accordance with the plans, specifications, profiles, maps and detailed drawings which have been prepared by the City Engineer, filed with the City Clerk, and which are hereby approved and adopted. Section 5. All of the work necessary to be done in connection with the making of said improvement shall be done and made by :©r? tract upon competitive bids; and said City of Yakima shall have and reserve the right to reject any and all bids. Section 6. There is hereby created a special fund, to be called "Local Improvement Fund, District No. 836", into which shall be paid all sums on account of the aforementioned special assessment, including all interest and penalties thereon; and, in the event of the sale of Local Improvement Bonds by this city, all premiums and interest on said bonds issued for said improvement. Section 7. Bonds bearing interest at the rate of 1 per annum, payable on or before 12 years from date of issuance, shall be issued in payment of the cost and ex- pense of said improvement; which bonds shall be redeemed by the collection of special assessments to be levied and assessed upon the property within said district, payable in 10 equal annual installments, with interest at the rate of 4% per annum, interest pay- able annually, under the mode of "Payment By Bonds" as defined by the statutes of the State of Washington and the ordinances of the City of Yakima. Section 8. This ordinance is one relating to local improvements or assess- ments therefor, and shall become effective immediately upon its passage, approval and publication as provided by the city charter.
