B -1$4$ AN ORDINANCE providing for the improvement of certain property by co nstructing pipe sew- ers with the necessary wye branches and manholes and flush tanks with water connections therefor; establishing a Local Improvement District, providing for the method of payment thereof, and creating a special fund. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. That the hereinafter described property in the City of Yakima, Washington, shall be improved by the construction of pipe sewers with the necessary wye branches, manholes and flush tanks with water connections therefor, and by doing such other work as may be necessary in connection therewith. - Section 2. There is hereby created and established a Local Improvement Dis trict to be called "Local Improvement District No. 834 ", which said district is describedI as follows: Beginning at the intersection of Mead Avenue and Sixth Avenue South; thence southerly along Sixth Avenue South to King Street; thence easterly along King Street to Fifth Avenue South; thence northerly along Fifth Avenue Sout to Mead Avenue; thence easterly along Mead Avenue to the center line of Third Avenue South; thence southerly along the centerline of Third Avenue South to Pierce Street; thence westerly along Pierce Street to Cornell Aven ue; thence northerly along Cornell Avenue to Mead Avenue; thence easterly a long Mead Avenue to the point of beginning, situate in Yakima County, Washington. Section 3. Except as hereinafter stated, all of the costs and expenses in connection with the making and construction of said improvement, including the engineer- ing, inspection, advertising, publication of notices, obtaining right -of -way easements and all other expenses incident thereto, shall be levied and assessed upon all of the property embraced within said Local Improvement District, in accordance with the special benefits conferred thereon, in the manner provided by the laws of the State of Washingto and the ordinances of the City of Yakima; and the said city shall not be liable in any manner for any portion of said ::costs and expenses of said improvement, except that the City Sewer Fund is to bear seventy -five (75%) percent of the cost of that portion of the Main Line beginning at the existing Truck Sewer on the Union Pacific Railroad right -of- way and extendingto the above described district. Section 4. All of the aforesaid construction shall be in full accordance with the plans, specifications, profiles, maps and detailed drawings which have been pre pared by the City Engineer, filed with the City Clerk, and which are hereby approved and adopted. Section 5. All of the work necessary to be done in connection with the mak ing of said improvement shall be done and made by contract upon competitive bids; and said City of Yakima shall have and reserve the rightto reject any and all bids. Section 6. There is hereby created a special fund, to be called "Local Im- provement Fund, District No. $34 ", into which shall be paid all sums on account of the aforementioned special assessment, including all interest and penalties thereon; and, in the event of the sale of Local Improvement Bonds by this city, all premiums and interest on said bonds issued for said improvement. • Section 7. Bonds bearing interest at the rate of 4% per annum, payable on or before 12 years from date of issuance, shall be issued in payment of the cost and expense of said improvemnt; which bonds shall be redeemed by the collection of special assessments to be levied and assessed upon the property within said district, payable in 10 equal annual installments, with interest at the rateof 4% per annum, interest payable annually, under the mode of "Payment By Bonds "..as defined by the statutes of the State of Washingt n and the ordinances of the City of Yakima. Section $. This ordinance is one relating to Local improvements or assess- ments therefor, and shall become effective immediately upon its passage, approval and publication as provided by the city charter.
