AN ORDINANCE relating to and regulating the sale, installation and servicing of heating appliances in the City of Yakima; providing for the enforcement thereof; prescribing penalties for violations thereof; and declaring an emergency. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. As used in this ordinance the following terms shall have the following meanings :`� a. "Heating Installers' means any person, firm or corporation who installs any or all types of heating appliances. b. "Journeyman" means any person engaged in the actual work of installing or servicing any heating appliance and who is the authorized holder of a valid and subsi sting " Journeyman's License ". . c. "Apprentice" means any person engaged in the actual work of installing or servicing any heating appliance and who is the authorized holder of a valid and sub sisting "Apprentice Permit ". d. "Heating Appliance" means an applicane which utilizes gas, liquid or solid fuel for the purpose of heat, and shall include all necessary piping. Such piping shall -not include duct work but shall include piping for all gas appliances including such appliances as gas refrigerators. Section 2. It shall be unlawful for any person, firm or corporation to en- gage in the business of installing any tupe of heating appliance without first having obtained and being the authorized holder of a valid and subsisting "Heating Installer',s License ", obtained according to and in compliance with the provisions of this ordinance, or without having filed with the City Clerk a valid and subsisting surety bond as here- inafter provided. Section 3. The fee for such Heating Installer's License shall be twenty- five Dollars ($25.00) and five dollars ($5.00) renewal, per annum for each establish- ment or place of business of each such heating installer, to be taken out in case of in- dividuals in the name of a person owning the business, and in the case of firms or cor- porations, in the name of such firm or corporation, and expires one year from date of issue. Section 4. The surety bond required of heating installers by section :'2 hereof shall be in the sum of one thousand dollars ($1,000.00) for each establishment or place of business maintained by any person, firm or corporation as a heating installer, payable to City of Yakima, for the use and benefit of said city and any and all persons dealing with the licenseeor his agents in his capacity as a heating installer, and shall be executed by the applicant and by a surety company authorized to do business in the State of Washington, which pond shall be conditioned that the licenseeand his agents shall fully comply with all provisions of law relating to installations of heating appli- ances, and that any person injured by failure to comply therewith may have a right of action on said bond in his own name, and that the, principal and sureties shall pay ally judgments recovered against the principal for any violation of or failure to comply with said provisions of law; provided that such action must be commenced within one (1) year after completion of the work. The surety on such bond shall not be s liable thereunder to any person in excess of the aggregate sum of one thousand dollars 01,000.00). Section 5. It shall be unlawful for any person to install or service any heating appliance without first having obtained and being the authorized holder of a valid and subsisting "Journeyman's License" or without first having obtained and being the authorized holder of a valid and subsisting "Apprentice Permit ", obtained according to and in compliance with the provisions of this ordinance. Section 6. The fee for such Journeyman's License shall be Five dollars ($5.00) and two dollars ($2.00) for renewal, per annum for each person. Section 7. No Journeyman's License shall be issued until such time as the applicant has made application to the Examining Board and has shown a proper degree of proficiency as determined by an examination conducted by the Examining Board. Said Journeyman's License may be issued for installation or servicing of heating appliances using solid, liquid or gas as a fuel. Said license shall indicate which type or types of fuel the holder is authorized to install or service. Section $. An Apprentice Permit shall be issued without charge upon written application signed by proposed employer under the following regulations: a. Number of apprentices shall not exceed the number ofjourneymen in any one employment. b. The holder of an Apprentice Permit shall work under the supervision of a journeyman. c. The holder of an Apprentice Permit for solid and gaseous fuel shall serve as an apprentice for a period of not less than three months nor more than twenty- - four months. d. The holder of an Apprentice Permit for liquid fuel shall serve as an apprentice for a period of not less thantwelve months nor more than thirty -six months. - Section 9. There is hereby created an Examining Board who shall periodically hold examinations for the purpose of determining the degree of proficiency of journeymen installers and service men and issuing Journeymen's Licenses to those qualified. The Examining Board shall consist of the Fire Marshal of the City of Yakima and two heating installers, appointed by the Mayor of the City of Yakima, who shall serve for a term of one year or until their successor has been duly appointed. Members of the Board shall serve without compensation. The Examining Board shall have the power to make rules and regulations not inconsistant with this ordinance. However, no limit shall be placed on the number of journeymen that may be licensed. 299 • ORDINANCE NO. B -1845 Section 10. Every person, firm or corporation selling a heating appliance to other than an authorized dealer, which is not to be installed by him or his agent, shall notify the Fire Marshal of the City of Yakima within seven (7) days after such sale upon forms to be provided by the Fire Department. Section 11. Any person, firm or corporation who shall violate or fail to - comply with any of the provisions of this ordinance, or who shall counsel, aid or abet any such violation or failure to comply, shall be deemed guilty of a misdemeanor, and upon conviction thereof, shall be punished by a fine in any sum not exceeding three hun- dred dollars (5300.00) or by imprisonment in the city jail for a term not exceeding ninety (90) days, or both such fine and imprisonment. Section 12. This ordinance is one to provide for the immediate preserva- tion of the public peace, property, health and safety of the people of the City of Yak- ima; and an emergency is hereby declared to exist, and said ordinance shall be in full force and effect from and after the date of its passate, approval and publication as provided for in the City Charter.
