AN ORDINANCE providing for the improvement of property in the City of Yakima by the con- struction of a domestic water system, establishing a local improvement dis- trict, providing for the method of payment therefor, and creating a special fund. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. That property in the City of Yakima, Washington, shall be im- proved by the construction of a domestic water system, with the necessary mains, fire hydrants, valves and other appurtenances for the purpose of supplying water for domestic use and fire protection; said improvement to serve the property the boundaries of which are described as follows: Beginning at the intersection of Mead Avenue and Cornell Avenue; thence easterly along Mead Avenue to Third Avenue South; thence southerly along Third Avenue South to Pierce Street; thence westerly along Pierce Street to Cornell Avenue; thence northerly along Cornell avenue to the point of be- ginning, excluding therefrom Lot 1 and Lots 9 to 1$ inclusive, of Block 3, Broadmead, and also excluding therefrom Lots $ and 9 of Cornell Tracts; said property being situate in Yakima, Yakima County, Washington; all of said improvement to be constructed in full accordance with the plans and specifi- cations to be prepared by the City Engineer. Section 2. There is hereby created and established a Local Improvement District, to be called "Local Improvement District No. $33" which said district shall in- clude all of the property described and set forth in Section 1 hereof. Section 3. A portion of the cost and expenses of said improvement, includ- ing the cost of acquiring right of way easements, engineering, surveying, advertising, inspection, publication of notices and other expenses incident thereto, the same being estimated by the City Engineer to be approximately 517,725.76, shall be levied and assess- ed upon all of the property embraced within said Local Improvement District, in accord- ance with the special benefits conferred thereon, in the manner provided by the laws of the State of Washington, and the ordinances of the City of Yakima; and the City Water Department shall pay the remainder of the cost and expense of said improvement, said por- tion being estimated by the City Engineer to be approximately the sum of $15,902.15, pursuant to segregation of said costs in accordance with Resolution No. C -1051, adopted on March 30, 1953. Section 4. All of the work necessary to be done in connection with the making of said improvement shall be done by the City of Yakima. . Section 5. There is hereby created a special fund, to be called "Local Improvement Fund, District No. $33 ", into which shall be paid all sums paid on account of the aforementioned special assessment, including all interest and penalties thereon; and in the event of the sale of Local Improvement Bonds by the city, all premiums and interest on said bonds issued for said improvement. Section 6. Bonds bearing interest at the rate of 4% per annum, payable on or before 12 years from date of issuance, shall be issued in payment of the cost and ex- pense of said improvement; which bonds shall be redeemed by the collection of special assessments to be levied and assessed upon the property within said district, payable in ten equal annual installments with interest at the rate of 4% per annum interest payable annually, under the mode of "Payment by Bonds ", as defined by the statutes of the State of Washington and the ordinances of the City of Yakima. Section 7. This ordinance is one relating to local improvements or assess- ments therefor, and shall become effective immediately upon its passage, approval and publication as provided . by the City Charter.
