ORDINANCE NO. B -1$3
AN ORDINANCE relating to Local Improvement Districts and assessments therein, imposing
certain additional requirements thereon pursuant to Chapters 353 and 364,
Laws of 1955, repealing certain ordinances in conflict herewith, and de-
claring an emergency.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. Within fifteen days after the city has awarded a contract for
the making of a local improvement, or within fifteen days after commencement of the work
on said improvement when the work is done by the city the city engineer shall cause to
be filed with the city treasurer the title of the improvement and district number and a
copy of the diagram or print showing the boundaries of the district and preliminary
assessment roll or abstract of same showing thereon the lots, tracts and parcels of land •
that will be especially benefited thereby and the estimated cost and expense of such im-
provement to be borne by each lot, tract, or parcel of land. The city treasurer shall
immediately post the proposed assessment roll upon his index of local improvement assess-
ments against the properties affected by the local improvement.
Section 2. There shall be included in the cost and expense of every local
improvement for assessment against the property in the district created to pay the same,
or any part thereof:
(1) The cost of the portion of the improvement within the street inter-
sections;
(2) The estimated cost and expense of all engineering and surveying neces-
sary for the improvement done under the supervision of the city engineer;
(3) The estimated cost and expense of ascertaining the ownership of the
lots or parcels of land included in the assessment district;
(4) The estimated cost and expense of advertising, mailing, and publishing
II all necessary notices;
(5) The estimated cost and expense of accounting, clerical labor, and of
books and blanks extended or used on the part of the city clerk and city treasurer in
connection with the improvement; which item shall be estimated at the sum of 000.00
per description; .
(6) All cost of the acquisition of rights of way, property, easements or
other facilities or rights, whether by eminent domain, purchase, gift, or in any other
manner: Provided, That the costs enumerated in this subsection may be excluded from the
cost and expense to be assessed against the property in such local improvement district
if the City Commission so designates by ordinance.
Section 3. All ordinances and parts of ordinances in conflict herewith,
and particularly Section 29 of Ordinance No. A -192, Section 1 of Ordinance No. A -337,
and Ordinance A -6$2, are hereby repealed.
Section 4. This ordinance is one to provide for the immediate preservation
of the public peace, property, health and safety of the people of the City of Yakima,
and an emergency is hereby declared to exist, and this ordinance shall be in full force
and effect from and after the date of its passage, approval and publication, as provided
by the City Charter.
