B -1$27 _ AN ORDINANCE regulating erection, constriction,enl'argement, alteration, repair, moving removal, conversion, demolition, occupancy, equipment, use, height, area and maintenance of buildings and /or structures in the City of Yakima; providing for the issuance of permits and collection of fees therefor; declaring and establishing fire districts; adopting with certain exceptions the Uniform Building Code, 1955 Edition; providing penalties for the violation thereof, and repealing all ordinances and/or parts of ordinances in conflict there- with. . BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. That the Uniform Building Code, 1955 edition, copyright, 1955 by the Pacific Coast Building Officials Conference, except as hereinafter specifically amended or changed, be and the same is hereby adopted as the Uniform Building Code of th:. City of Yakima, and the provisions and regulations thereof are hereby adopted as the pro visions and regulations of the City of Yakima and the several sections as numbered there n shall constitute the numbers and may be referred to as the numbers of this ordinance. Section 2. That that portion of Section 402 of said Uniform Building Code, 1955 edition, defining the term "alley" is hereby amended and changed insofar as the same shall apply to the City of Yakima, as follows: "Alley. A thoroughfare less that twenty (20) feet in width, or an unnamed thoroughfare twenty (20) feet or more in width." Section 3. The fire zones referred to in Section 1601 (a) thereof shall be as provided in Ordinances No. B -906 and B -1447. Section 4. That there is hereby added to Section 1001, Group E occupancies the following Division relating to bulk oil storage plants: "Division 6. Bulk oil storage plant shall mean a plant used for the blend - i.ng:'or sale of flammable liquids at wholesale. Earth or concrete dikes shall be built around such storage plants capable of containing the fluids of the largesttank plus 10% of the contents of all other tanks in the plant in case of damage or fire. Such dikes are subject to approval by the fire marshal." Section 5. Section 3206 of said Uniform Building Code, 1955 edition, is hereby amended and changed insofar as the same shall apply to the City of Yakima to read as follows: "The water from the roof of all buildings which would flow by gravity over public sidewalk shall be carried by means of conductors unddr the sidewalk and to the storm sewer, or street gutter where there is no storm sewer. Overflows shall be installed at each low point of the roof to which the water drains. Concealed roof drainage pipe shall be installed as required for soil, waste or vent piping. "Exception: Buildings of Group "I" of "J" occupancies, the walls of which are ten feet (10') or more from the street property line, need not comply with the above provision. "Yard drainage shall be to dry wells, or through settling basins to a storm sewer." Section 6. That portion of Chapter 37 thereof dealing with vents for gas appliances shall be administered by the city fire prevention bureau. Section 7. Subdivision (d) of Section 3702 is hereby amended and changed insofar as the same applies to the City of Yakima, to read as follows: . "In single family dwellings more than one connection may be made to a flue irrespective of the kind of.fui used, provided that no two connections are made at the same level or opposite each other. In all other construction there shall be but one connection to a.flue irrespective of fuel used. No flue shall be smaller in area than the flue connection on the appliance at- tached thereto. Ordinary and low pressure heating devices burning solid fuels shall have a minimum effective flue area not less than prescribed in the following table. The cross section of the effective area of a flue sha 1 have its least dimension not less than two- thirds of its long dimension. Inlets to a flue shall be not less than 1$ inches from ceiling line to top •f edge of inlet." Section E. Paragraph 2 of Section 3801 thereof is hereby amended and chang -. insofar as the same applies to the City of Yakima, to read as follows: ?2. In all cellars in Group A. and B occupancies and in other cellars when the floor area exceeds fifteen hundred square feet (1500 sq. ft.), except that such installation shall not be required in the cellars of Type 1 buildings occupied by a banking insitutition or other similar business in- stitution." Section 9. Sections 3$05 and 3$06 of said Uniform Building Code, 1955 edi -:i tion, are hereby omitted as applied to the City of Yakima. Section 10. Chapter 42 of said Uniform Building Code 1955 edition, shall not become effective until a list of the ordinary interior finished and their flanespread classifications have been approved by the Yakima CityCommission. 9 ! : ND 1 EC ev OFIDMAI Cs PIC). Section 4502 thereof is hereby amended and changed to read as follows, as the same applies to the City of Yakima: "Section 4502. No part of any structure or any appendage thereto, except signs, shall project into any alley, except that a curb or buffer block may project not more than 9 inches and not exceed a height of 9 inches above grade; provided, however, that nothing contained in this Code shall prevent the construction of suitable marquees over secondary hotel entrances on alleys. Plans and specifications for any such marquee shall first be appro- ved by the Building Department and the City Commission before construction thereof shall be commenced and no such marquee may be constructed unless in the opinion of the City Commission the construction thereof shall not un- reasonably interfere with the flow of traffic through such alley. The con- struction of said marquees may be approved by the City Commission without reference to the provisions of Section 4505 of this Code." section 12. Except for Section 510$, regulating the construction of incin -. erators, the appendix of said 1955 Uniform Building Code is not adopted in the City of Yakima. Section 13.. Ordinance No. B -1014 passed and approved by the City Commission of the 31st day of May, 1949, and Ordinance No. B -539, passed on October 21, 1941, and R No. C -950, adopted on January 22, 1951, and all ordinances or parts of ordi- nances in conflict with this ordinance, are• hereby reealed, PROVIDED, however, this ordinance shall not affect any action or proceeding had or commenced in any civil or criminal cause before this ordinance and its respective provisions took effect, and any such actions or proceedings may be prosecuted and continued with the same effect and under the same provisions of the law in effect at the time such act was done or action or pro- ceeding has or commenced, and any offense declared to be an .offense in any provisions of the: ordinances of this city which are repealed by this act and the commission whereof have been completed before the effective date of this act, shall be punishable as pro- vided by the law in effect at the time of the completion of such acts, without regard 1 for the fact that such provisions of law have been repealed hereby. Section 14. Three copies of said 1955 editions, Uniform Building Code of the Pacific Coast Building Officials, Conference, shall be filed for use and examination by the public in the office of the City Clerk, and any_and all amendments and additions to said code, when printed and filed with the City:_,Cle shall be considered and accept- ed as official amendments and additions to such code without further adoption thereof by the City. Section 15. This ordinance shall be, and is hereby declared to be in full force and effect thirty (30) days from and after its final passage and approval and publication, as provided by the City Charter.
