ORDINANCE NO. B -1$22
AN ORDINANCE amending Section 1 of Ordinance No. B -1739 entitled "AN ORDINANCE providing
for the acquisition by condemnation or purchase of certain real property
owned by William S. Webber located in and being a part of the East half of
the N quarter of the Northwest quarter of Section 23, Township 13
North, Range 18 E.W.M., in Yakima County; Washington, for public park pur-
poses, and providing for the method_ of payment therefor, and declaring an
emergency ", and declaring an emergency.
BE IT ORDAINED BY THE C ITY, OF YAK IMA
Section 1. Section 1 of Ordinance No. B passedton September 6, 1955,
entitled as shown in the caption hereof, is hereby amended to read as follows:
"Section 1. That it is necessary that the City of Yakima acquire .title to
the following described real property situate in the City of Yakima, Yakima County,
Washington, to -wit: .
That part of the East half of the Northwest quarter of the Northwest quarter
of Section 23, Township 13 North, Range 1$ E.W.M., lying south and west of
the right of way of the Powerhouse Road;
EXCEPT right of way of the canal of. the Pacific Power and Light Company, and
EXCEPT right of way of the Naches and Cowiche Canal, and
EXCEPT the south 745 feet of said tract of real estate (which said south 745
feet includes the north 25 feet of Lincoln Avenue);
TOGETHER WITH all appurtenances and water rights thereunto appertaining and
belonging; .
!' for the purpose of establishing, constructing, and maintaing a public park thereon in
I, said City; and it is hereby ordained that title to said real property above described be
acquired by purchase or condemnation proceedings, as provided by law for the acquisition
of property for such public use."
Section 2. This ordinance is one to provide for the immediate preservation
of the public peace, property, health and safety, and an emergency is delared to exist,
and this ordinance shall be in full force and effect immediately upon its passage, appro-
val, and publication as provided by law and the City Charter.
PASSED BY THE _CITY COMMISSION, signed and approved this 16th day of
January, 1956.
