B -1$17 AN ORDINANCE providing for the improvement of certain property by constructing pipe sew- ers with the necessary wye branches and manholes; establishing a Local Improvement District, providing for the method of payment thereof, and crea ting a special fund. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. That the hereinafter described property in the City of Yakima, Washington, shall be improved by the construction of pipe sewers with the necessary wye branches and manholes, and by doing such other work as may be necessary in connection therewith. Section 2. There is hereby created and established a Local Improvement District to be called "Local Improvement District No. $31" which said district is de- scribed as follows: Lots 1 to 16 inclusive of Westwood Addition; Lots 1 to 15 inclusive of Ressel Homesites; Lots 1 to 2$ inclusive of Englewood Park; Lots 1 and 12, Block 4, The Uplands; all according to the official plats thereof recorded in the office of the Auditor of Yakima County, Washington; AND the east 125 feet of the west 4£35 feet of the South 135 feet of the north 165 feet of the northwest quarter of the northeast quarter of Sec- tion 21, Township 13 North, Range 1$ E.W.M., Yakima County, Washington. Section 3. All of the costs and expenses in connection with the making and construction of said improvement, including the engineering, inspection, advertis- ing, publication of notices, obtaining right -of -way easements and all other expenses incident thereto, shall be levied and assessed upon all of the property embraced within said Local Improvement District, in accordance with the special benefits conferred thereon, in the manner provided by the laws of the State of Washington and the ordinan- ces of the City of Yakima; and the said city shall not be liable in any manner for any portion of said costs and expenses of said improvement. Section 4. All of the aforesaid construction shall be in full accordance with the plans, specifications, profiles, maps and detailedcrawings which have been prepared by the City Engineer, filed with the CityClerk, and which are hereby approved and adopted. Section 5. All of the work necessary to be done in connection with the making of said improvement shall be done and made by contract upon competitive bids; and said City of Yakima shall shall have and reserve the right to reject any and all bid.. Section 6. Thereis hereby created a special fund, to be called "Local Improvement Fund, District No. $31 ", into which shall be paid all sums on account of the aforementioned special assessment, including all interest and penalties thereon; and, in the event of the sale of Local Improvement bonds by this city, all premiums and interest on said bonds issued for said improvement. Section 7. Bonds bearing interest at the rate of 4% per annum, payable on or before 12 years from date of issuance, shall be issued in payment of the cost and expense of said improvement; which bonds shall be redeemed by the collection of special assessments to be levied and assessed upon the property within said district, payable in 10 equal annual installments, with interest at the rate of 4% per annum, interest payable annually, under the mode of "Payment by Bonds" as defined by the Statutes of the State of Washington and the ordinances of the City of Yakima. Section 8. This ordinance is one relating to local improvements or assess- ments therefor, and shall become effective immediately upon its passage, approval and publication as provided by the city charter.
