B -1£ 11 AN ORDINANCE amending Section 16 of the Zoning Ordinance No. B -293, entitled "AN ORDIN- ANCE regulating and restricting the location of trades and industries; regulating and limiting the use of buildings and premises; and the height and size of buildings; providing for yards, courts and other open spaces; establishing districts for said purposes, and providing for a board of ad- justment, and repealing Ordinances Nos. B -22, B -35, B -43, B -51, B -71, B -126. B -134, B -147 and B- 172 "; requiring that any non - residential building or struc- ture located on; -a designated arterial shall be set back not less that 50 feet from the front lot line, as to new construction, except in the down- town business district, authorizing waiver by the Building Inspector of said requirement under certain conditions where adequate off- street parking is provided, and repealing Ordinance No. B -173$. WHEREAS, the passage of this ordinance has been recommended by the City Planning Commission by reason of the increased congestion of arterials and the lack of adequate off - street parking facilities; now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. Section 15 of the Zoning Ordinance No. B -293, passed on March 2$, 1938, entitled as shown in the caption hereof, as amended, is hereby amended by adding thereto at the end thereof two additional subsections to be designated "(g)" and "(h) " reading as follows: M F.R1 OF;O 63v ORDINANCE N®.. d �� "(g)" Any non-residential o building or structure located on a designated arterial shall be set back not less than fifty (50) feet from the, front lot line. However, this provision may be waived by the Building Inspector if it is established to his reasonable satisfaction that adequate off - street parking space will be provided as hereinafter specified in subsection (h) hereof. The provisions of subsection (g) apply to new construction only, and do not apply to the downtown business district as defined in the offic- ial map of the "Downtown Business District" adpoted as a part of this ordi- nance and described as follows: "Beginning at the intereection of the center line of East "C" Street and North Naches Avenue, thence south alongth.e'center line of Naches Avenue to the center line of East Walnut Street , thence west along the line of Walnut Street to the center line of 6th Avenue South, thence north along the center line of 6th Avenue South to the center line of West Chestnut Street, thence west along the center line of West Chestnut Street to the center line of 10th Avenue South, thence north along the center line of loth Avenue to the center line of Summitview Avenue, thence east along the center line of Summitview Avenue, to the center line of West Yakima Avenue, thence east along the center line of West Yakima Avenue to the center line of 5th Avenue, thence North along the center line of 5th Avenue to the cen- ter line of West "C" Street, thence east along the center line of "C" Street to the point of beginning. P?(h)" In the event that a waiver of the provisions of subsection (g) is re- quested, the following requiredments shall be used to determine the adequ- acy of off - street parking spaces: "1. MINIMUM PARKING SPACE REQTJIREMENTS: There shall be established and maintained a permanent, dust free, off - street parking area within five hundred (500) feet of the building or structure. UNSPECIFIED USES. In the case of a use not specifically mentioned in this subsection, the requirements for off - street parking facilities shall be the same as for the above mentioned uses which in the opinion of the Building Inspector, shall be deemed most similar. 3. MIXED OCCUPANCIES: In the case of mixed uses, the total requirements for off - street parking facilities shall be the -sum of the requirements for the various uses computed separately. Off- street parking facilities for one use shall not be considred as providing required facilities for any other use, except as hereinafter specified for cooperative use. 4. COOPERATIVE PROVISION: Nothing in this subsection shall be construed to prevent cooperative provision of off- street parking facilities for two or more uses, provided that the total of such off - street parking spaces supplied cooperatively shall not be less than the sum of the requirements for the various uses . computed separately. None of the above provisions shall prevent the overlapping cooperative uses of park- ing facilities when the times during which such facilities are used, are not conflicting. 5. DEFINITION OF A PARKING SPACE: For the purpose of this subsection, two hundred (200) square feet of lot or floor area having adequate access from a public thoroughfare shall be deemed a parking space for one automobile. 6. DEFINITION OF GROSS FLOOR AREA: Gross floor area in the case of offices merchandising or service types of uses shall mean the gross floor area used, or intended to be used, by tenants or for services to the public as customers, patrons, clients or patients, including area occupied by fixtures and equipment used for display or sale of merchandise. It shall not include area used principally for non - public purposes such as storage, incidental repair, processing or packaging of merchandise for show windows, for offices incidental to the management or maintenance of stores or buildings, for toilet or rest rooms, for utilities, or for dressing rooms, fitting or alteration rooms. Section 2. Ordinance No. B -1738, passed on September 6, 1955, is hereby repealed. Section 3. This ordinance shall be in full force and effect thirty (30) days after its passage, approval and publication as provided by law and City Charter.
