B -1$09 AN ORDINANCE providing for the expenditure of funds not budgeted for the payment for the acquisition of a portion of Lenox Avenue pursuant to condemnation proceed- ing judgment heretofore entered, and declaring an emergency. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. That an emergency exists requiring the payment to Washington Canners Cooperative, a corporation, for a portion of Lenox Avenue near its place of busi- ness pursuant to jedgment entered on November 2$, 1953, in condemnation proceeding Cause No. 38834- in the Yakima County Superior Court, in the sum of $625.00 plus taxable costs in the sum of $127.40, or the total sum of $752.40; and it is deemed for the best inter- est of the city of Yakima that said payments be made and that a decree be entered appro- priating title to said portion of Lenox Avenue to the City of Yakima; and it appearing that funds therefor were not appropriated or included:'in the 1955 budget, and that it was impossible at the time of making said budget to have reasonably foreseen the need for such monies for said purpose. Section 2. The City Treasurer is hereby authorized, empowered, and directed to issue emergency warrants upon the funds properly chargeable therefor for said pur- poses in a sum not to exceed $752.40, upon the presentation of proper vouchers therefor. Section 3. This ordinance is one providing for the expenditure of funds not budgeted, and an emergency is declared to exist, and this ordinance shall become effective immediately upon its passage, approval and Ipublication as provided by law and the City Charter.
