ORDINANCE NO. B -17$3
AN ORDINANCE providing for the improvement of certain property by grading, ballasting,
surfacing and constructing concrete curbs and gutters; establishing a
Local Improvement District, providing for the method of payment therefor,
and creating a special fund. .
BE IT ORDAINED BY THE CITY OF YAKIMA:

Section 1. That the east side of 26th Avenue South beginning at a point
100 feet south of the south line of Tieton Drive and extending south 260 feet shall be
improved by grading, ballasting, surfacing and constructing concrete curbs and gutters,
and to be constructed in full accordance with the plans and specifications prepared by
the City Engineer and filed with the City Clerk. The property to be benefited by this
improvement consists of the following: .
Beginning at a point on the north line of Nob Hill Boulevard 14.0 feet east
of the east line of 26th Avenue South; thence northerly and parallel with
26th Avenue South to Tieton Drive; thence westerly along Tieton Drive a
distance of 330 feet; thence southerly and parallel with 26th Avenue
South to Nob Hill Boulevard; thence easterly along said Boulevard to the
point of beginning.
Section 2. There is hereby created a Local Improvement District to be
called Local :Improvement District No. $29, which said district shall include all of the
property described and set forth in Section 1 hereof.
Section 3. All of the cost and expense in connection with the making and
construction of said improvement, including the cost and expense of acquiring right -of-
way easements, engineering, inspection, advertising, publication of notices, and all
other expenses incident thereto, shall be levied and assessed upon all of the property
embraced within said Local Improvement District accordance with the special benefits
conferred thereon, in the manner provided by the laws of the State of Washington and
the Ordinances of the City of Yakima, and said City shall not be liable in any manner
for any portion of said cost and expense of said improvement.
Section 4. All of the aforesaid construction work shall be in accordance
with the plans, specifications, profiles, maps, and detailed drawings which have been
prepared by the City Engineer, filed with the City Clerk, and which are hereby approved
and adopted.
Section 5. All of the work necessary to be done in connection 4th the mak-
ing of said improvement shall be done and made by contract upon competitive bids; and
the City shall have the power to reject any and all bids.
Section 6. There is hereby created a special fund to be called "Local
Improvement Fund, District No. $29," into which shall be placed all sums paid on account
of the aforesaid special assessments, including all interest and penalties thereon; and,
in the event of the sale of Local Improvement Bonds by this City, all premiums and
interest on said bonds issued for said improvement.
Section 7. Bonds bearing interest at the rate of 4 per cent per annum,
payable on or before 12 years from date of issuance, shall be issued in payment of the
cost and expense of said improvement; which bonds shall be redeemed by the collection of
special assessments to be levied and assessed upon the property within said district,
payable in 10 equal annual installments, with interest at the rate of 4 per cent per
annum, interest payable annually, under the mode of "Payment by Bonds" as defined by
the statutes of the State of Washington and the Ordinances of the City of Yakima.
Section $. This ordinance is one relating to local improvements or assess-
ments therefor, and shall become effective immediately upon its passage, approval and
publication as provided by City Charter.
PASSED BY THE CITY COMMISSION, signed and approved, this 21st day of
November, 1955.
