AN ORDINANCE providing for the improvement of certain property by grading, and paving'
with asphaltic concrete placed on a crushed rock base; establishing a
Local Improvement District, " providing for the method of payment therefor,
and creating a special fund.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. That various alleys in the City of Yakima shall be improved by
grading and paving with asphaltic concrete placed on a crushed rock base, all 'of said
improvements to be constructed in full accordance._with the plans and specifications
prepared by the City Engineer and filed with the Clerk. The property to be benefit-
ed by this improvement consists of the following, to -wit: •
Lots i to 16, inclusive, Block $9, Original Townsite of North
Yakima, now City of Yakima;
Lots 1 to 16- inclusive, Block 109, Original Townsite of North
Yakima, now pity of Yakima; . •
Lots 1 to 20, inclusive, Block 35, New Modern Addition;
Lots 1 to 24, inclusive Block 2, Hi_ilcrest Addition;
according to the recorded plats thereof recorded in the • •
office of the Auditor of Yakima County, Washington.
Section 2. There is hereby created a Local Improvement District to be call-
ed Local Improvement District No. 82$, which said.district shall include all of the.
property described and set forth in Section 1 hereof.
Section 3. All of the cost and expense in connection with the making and
construction of said improvement, including the cost and expense of engineering, inspec-
tion, advertising, publication of notices and all other expenses incident thereto, shall
be levied and assessed upon all of the property embraced within said Local Improvement
District in accordance with the special benefits conferred thereon, in the manner and as
provided by the laws of the State of Washington and the Ordinances of the City of Yakima,
and said City shall not be liable in any manner for any portion of said costs and expens-
es of said improvement.
Section 4. All of the aforesaid construction work shall be in accordance
with the plans, specifications, profiles, maps and detailed drawings which have been pre-
pared by the City Engineer, filed with the City Clerk and which are hereby approved and
adopted.
Section 5. All of the work necessary to be done in connection with the
making of said improvement shall be done and made by contract upon competitive bids;
and the City shall have the power to reject any and all bids.
Section 6. There is hereby created a special fund to be called "Local
Improvement Fund, District No. 82b ", into which shall be placed all sums paid on account
of the aforesaid special assessments, including all interest and penalties thereon; and,
in the event of the sale of Local Improvement Bonds by said City, all premiums and
interest on said bonds issued for said improvement.
Section 7. Bonds bearing interest at the rate of 4% per annum, payable on
or before 12 years from the date of issuance, shall be issued in payment of the cost and
expense of said improvement; which bonds shall be redeemed by the collection of special
assessments to be levied and'assessed upon the property within said district, payable in
10 equal annual installments, with interest at the rate of 4 percent per annum, interest
payable annually, under the mode of "Payment by Bonds" as defined by the statutes of the
State of Washington, and the Ordinances of the City of Yakima.
Section 8. This ordinance is one relating to local improvements or assess-
. ments therefor, and shall become effective immediately upon its passage, approval and
publication as provided by the C ity Charter.
