B -1745 AN ORDINANCE providing for the improvement of certain property by grading, ballasting, surfacing and constructing concrete curbs and gutters; establishing a local improvement district, providing for the method of payment therefor, and cre- ating a special fund. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. That 38th Avenue North from Summitview Avenue to the North line of Glenview Addition and Mavis Avenue from 38th Avenue North to the Yakima Valley Canal Co.'s right -of -way shall be improved by grading, ballasting, surfacing and constructing concrete curbs and gutters, together with the necessary drainage features; all of said improvements to be constructed in full accordance with the plans and specifications pre- pared by the City Engineer and filed with the City Clerk. The property to be benefited by this improvement consists of the following: Lots 1 to 19, inclusive, of Glenview Addition and vacated Knobel Avenue from 38th Avenue North,to the Yakima Valley Canal Co.'s right -of -way, in the City of Yakima, Yakima County, Washington. Section 2. There is hereby created a Local Improvement District to be caller "Local Improvement District No. 821 ", which said district shall include all of the pro- perty described and set forth in Section 1 hereof. Section 3. All of the costs and expenses in connection with the constructioH of said improvement, including the•cost and expense of engineering, inspection, adver- tising, nublication.of notices and all other expenses incident thereto, shall be levied and assessed upon all of the property embraced within said Local Improvement District in accordance with the special benefits conferred thereon, in the manner and as provided by the laws of the State of Washington, and the ordinances of the.City of Yakima, and said city shall not be liable in any manner for any portion of said costs and expenses of said improvement. 11 Section 4. All of the aforesaid construction work shall be in accordance with the plans and specifications, profiles, maps and detailed drawings which have been prepared by the City Engineer, filed with the City Clerk, and which are hereby approved and adopted.. Section 5. All of the work necessary to be done in connection with the mak- ing of said improvement shall be done and made by contract upon, competitive bids; and the City shall have the power to reject any and all bids. Section 6. There is . hereby created a special fund to be called "Local Im- provement Fund, District No. 821 ", into which shall be placed all sums paid on account of the aforesaid special assessment, including all interest and penalties thereon; and, in the event of the sale of Local Improvement Bonds by the City, all premiums and interest on said bonds issued for said improvement. Section 7. Bonds bearing interest at the rate of k% per annum, payable on o' before 12 years from the date of issuance, shall be issued in payment of the cost and ex- pense of said improvement, which bonds shall be redeemed by the collection of special assessments to be levied and assessed upon the property within said district payable in 10 equal annual installments, with interest at the rate of 4% per annum, interest payable annually, under the mode of "Payment by Bonds" as defined by the statutes of the State of Washington and the ordinances of the City of Yakima. Section 8. This ordinance is one relating to local improvements or assess- ments therefor, and shall become effective immediately upon its passage, approval and pub lication as provided by the City Charter.
