ORDINANCE•NO. B -1697
AN ORDINANCE providing for the improvement of certain property by constructing a pipe
sewer with the necessary wye branches, extensions, manhole, flush tank, and
water connection; establishing a Local Improvement District, providing for
the method of payment therefor, and creating a:special fund.
BE IT ORDAINED BY THE CITY OF YAKIMA:
1 1 Section 1. That the hereinafter described property in the City of Yakima,
Washington, shall be improved by the construction of a pipe sewer with the necessary wye
branches, extensions, manhole, flush tank, and water connection therefor, and by doing all
such other work as may be necessary in connection therewith.
Section 2. There is hereby. created and established a Local Improvement
District to be called "Local Improvement District No 809" which said district is describ
ed as follows: •
• Beginning at the intersection of the center lines of West Viola Avenue
and 22nd Avenue South; thence North along the center line of 22nd
Avenue South 225.6. feet; thence East 166.2 feet; thence North 105 feet;
thence East to a point 111 feet•East of 21st Avenue South; thence
South to the center line of -West Viola Avenue; thence West along said
center line .to the point of beginning, situate in the City of Yakima,
Yakima County, Washington.

Section 3. All of the costs and expenses in connection with the making and
construction of said improvement, including the engineering, inspection, advertising, pus
lication of notices, cost of acquiring right -of -way easements, and all other expenses
incident thereto, shall be levied and assessed upon all of the property embraced within
said Local Improvement District, in accordance with the special benefits conferred there -
on, and in the manner provided by the Laws of the State of Washington and the Ordinances
of the City of Yakima; and the said City shall not be liable in any manner for any portion
of said costs and expenses of said improvement.
Section 4. All of the aforesaid construction shall be in full accordance
with the plans, specifications, profiles, maps and detailed drawings which have been pre-
-pared by the City Engineer, .filed with the City Clerk, and whcih are hereby approved and
adopted.

Section 5. All of the work necessary to be done in connection with the mak-
ing of said improvement shall be done and made by contract upon competitive bids; and sale
City of Yakima shall have and reserve the right to reject any and all bids.
Section 6. There is hereby created a special fund, to be called "Local Im-
provement Fund, District No. 809 ", into which shall be paid all sums on account of the
aforementioned special assessments, including all interest and penalties thereon; and, in
the event of -the sale of Local Improvement Bonds by this City, all premiums and interest
-on said bonds issued for said improvement.
Section 7. Bonds bearing interest at the rate of 4% per annum, payable on o'
before 12 years from date of issuance, shall be issued in payment of the cost and expense
of said improvement; which bonds shall be redeemed by the collection of special assess-
ments to be levied and assessed upon the property within said district, payable in 10 •
equal annual installments, with interest at the rate of 4% per annum, interest payable
annually, under the mode of "Payment by Bonds" as defined by the Statutes of the State of
Washington, and the ordinances of the City of Yakima.
11 Section 8. This ordinance is one relating to local improvements or assess
ments therefor, and shall become effective immediately upon its passage, approval and pu.
lication as .provided by City Charter.
