ORDINANCE. NO. .B -1688

AN ORDINANCE providing for the expenditure of funds not budgeted for the payment of
witness fees in court litigation pertaining to a city sewer line, and de-
claring an emergency..
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. That an emergency exists requiring the expenditure of the sum
of 81193.82 for the payment of the following witness fees, mileage and expenses, namely,
Walter Kirby, $10.00, W. C. Britt, $ ?10. 00, Roland A. Gribaudo, (of Seattle) $28.00,
0. E. Brashears, $250.00, and Stevens and Thompson, (by their partner Marvin Runyan, of
Portland, Oregon) $895.82, said Brashears and Runyan being expert engineering witnesses
who were necessarily in attendance during a large part of the trial, all of the fore-
going being for witness fees of the city's witnesses in a Superior Court'trial of liti-
gation brought by Leslie and Anna Wadekamper against the City of Yakima to recover a
large amount of damages alleged to have been caused by the city sewer and drain line to
Union Gap; it appearing that sufficient funds therefor were not appropriated or included
in the 1955 budget, and that it was impossible at the time of making said budget to have
reasonably foreseen the need for such additional monies for said purpose.
Section 2. The City Treasurer is hereby authorized, empowered, and directed
to issue emergency warrants upon the current expense fund for said purpose in the said
total sum of $1193.82, upon the presentation of proper vouchers therefor.
Sect -ion 3. This ordinance is one providing for the expenditure of funds
not budgeted, and an emergency is declared to exist, and this ordinance shall become
effective immediately upon its passage, approval and publication as provided by 1'aw and
the City Charter.
PASSED BY THE CITY COMMISSION, signed and approved this 9th day of May,
1955.
