AN ORDINANCE providing for the improvement of certain property by constructing a pipe
sewer with the necessary wye branches, manholes, and flush tank; establish-
ing a Local Improvement District, providing for the method of payment there-
for, and creating a special fund.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. That the hereinafter described property in the City of Yakima,
Washington, shall be improved by the construction of a pipe sewer with the necessary wye
branches, manholes and flush tanks, and by doing -all such other work as may be necessary
in connection therewith.
Section 2. There is hereby created and established a Local Improvement
District to be called "Local Improvement District No. 807" which said district is des-
cribed as follows: -
Beginning at a point on the South line of West Chestnut Street 100 feet
West of 34th Avenue South; thence sourtherly and parallel with 34th Avenue
South 91 feet; thence easterly and parallel with West Chestnut Street
to 34th Avenue South; thence southerly along 34th Avenue South to West
Walnut Street; thence westerly along West Walnut Street to a point midway
between 34th Avenue South and 35th Avenue South; thence southerly along a
line midway between34th Avenue South and 35th Avenue South to Tieton Drive;
thence westerly along Tieton Drive to 35th Avenue South; thence northerly
along 35th Avenue South to the South line of West Chestnut Street; thence
Easterly along said South line to the point of beginning, situate in the
City of Yakima, Yakima County, Washington.
Section 3. All of the costs and expenses in connection with the making and
construction of said improvement, including the engineering, inspection, advertising,
publication of notices, cost of acquiring right of way easements, and all other expenses
incident thereto, shall be levied and assessed upon all of the property embraced within
said Local Improvement District, in accordance with the special benefits conferred there-
on, in the manner provided by the laws of the State of Washington, and the ordinances of
the City of Yakima; and the said City shall not be liable in any manner for any portion
of said improvement.
Section 4. All of the aforesaid construction shall be in full accordance
with the plans, specifications, profiles, maps and detailed drawings which have been
prepared by the City Engineer, filed with the City Clerk, and which are hereby approved
and adopted. .
Section 5. All of the work necessary to be done in connection with the mak-
ing of said improvement shall be done and made by contract upon competitive bids; and
said City of Yakima shall have and reserve the right to reject any and all bids.
Section 6. There is hereby created a special fund, to be called "Local Im-
provement Fund, District No. 807 ", into which shall be paid all sums on account of the
aforementioned special assessments, including all interest and penalties thereon; and, in
the event of the sale of Local Improvement Bonds by this City, all premiums and interest
on said bonds issued for said improvement.
Section 7. Bonds bearing interest at the rate of 4% per annum, payable on
or before 12 years from date of issuance, shall be issued in payment of the cost and ex-
pense of said improvement; which bonds shall be redeemed by the collection of special
assessments to be levied and assessed upon the property within said district, payable in
10 equal annual installments, with interest at the rate of 4% per annum, interest payable
annually, under the mode of "Payment by Bonds" as defined by the Statutes of the State of
Washington, and the ordinances of the City of Yakima.
Section 8. This ordinance is one relating to local improvements or assess—
ments therefor, and shall become effective immedately upon its passage, approval, and
publication as provided by City Charter.
PASSED BY THE CITY COMMISSION, signed and approved this 2nd day of May,
1955.
