B -1682 AN ORDINANCE licensing the distribution or sale of stamps, coupons, tickets, cards or other similar devices which entitle holders thereof to cash, money, goods, wares, . or merchandise free; fixing the amount of such license; defining offenses, prescribing penalties, repealing Ordinance No. A -102; and declar- ing an emergency. • BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. It shall be unlawful for any person, firm or corporation to distribute to merchants, sponsor, or sell any stamps, coupons, tickets, cards or other similar devices for use in connection with the sale of goods•,•wares, and merchandise, which said stamps, coupons, tickets or other similar devices ,shall entitle the purchaser receiving the same to procure from any person, firm or corporation any cash, money, goods, wares, or merchandise free of charge upon production <•:of�•any number of said stamps, tickets, coupons, cards or other similar devices, without first obtaining an annual lic- ense therefor from the City Clerk and without first paying to the said City Clerk an annual license fee in an amount to be.fixed as herein provided. Section 2. The license `.fee..,as prescribed by the preceding section hereof 'shall be a minimum fee of $300.00 annually. For each person, firm or corporation within the City of Yakima, in excess of ten (10), to which a licensee hereunder sells or dis- tributes any stamps, coupons, tickets, cards, or other similar devices which entitle the holder thereof to procure from any person, firm or corporation any cash, money, goods, wares, or merchandise free of charge, the annual license fee shall be increased by x$10.00. Such license fee shall be fixed at the annual renewal date thereof on the basis of the number o•f such persons, firms, or corporations to which a licensee is selling such stamps, coupons, tickets, cards, or other devices at such renewal date. Section 3. Before obtaining such license, the person applying therefor shall cause the person, agency, or trustee holding redemption funds for such stamps, coupons, tickets or other similar devices to be bonded in the amount of $20,000.00, and shall file with the City Clerk a copy of such bond. Section 4. Any person, firm, or corporation failing to comply with the terms of this ordinance or violating the terms thereof, or any part thereof, shall be guilty of a misdemeanor and upon conviction of such violation shall be punished by a fine in any sum not exceeding $300.00, or by imprisonment in the city jail for a term not exceeding 90 days, or by both such fine and imprisonment. Section 5. Ordinance No. A -102 passed on December 23, 1912, is hereby re- pealed. Section 6. This ordinance is one to provide for the immediate preservation of the public peace, property, health and safety, and an emergency is declared to exist, and this ordinance shall be in full force and effect immediately upon its passage, ap- proval,and publication as provided by law and the City Charter.
