B -1680 AN ORDINANCE providing for the improvement of certain property by grading and paving with asphaltic concrete placed on a crushed rock base; establishing a Local Improvement District, providing for the method of payment therefor, and ere ating a special fund. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. That the alley in Block 28, Yakima, and the, alley in Block 351, Capitol Addition to the City of Yakima, shall be improved by grading and paving with asphaltic concrete placed on a crushed rock base, all of said improvements to be con- structed in full accordance with the plans and specifications prepared by the City Engi- neer and filed with the City Clerk. The property to be benefited by this improvement consists of the following, to -wit: Lots 1 to 32 inclusive of Block 28, Yakima; also Lots 1 to 16 inclusive of Block 351, Capitol Addition to the City of Yakima, Yakima County, Washington. , Section._2. There is hereby created a Local Improvement District to be called Local Improvement District No. 805, which said district shall include all of the property described and set forth in Section 1 hereof. Section 3. All of the cost and expense in connection with the making and construction of said improvement, including the cost and expense of engineering, inspec- tion, advertising, publication of notices and all other expenses incident thereto, shall be levied and assessed upon all of the property embraced within said Local Improvement District in accordance with the special benefits conferred thereon, in the manner and as provided by the laws of the State of Washington and the Ordinances of the City of Yakima and said City shall not be liable in any manner for any portion of said cost and expense of said improvement. Section 4. All of the aforesaid construction work shall be in accordance with the plans, specifications, profiles, maps and detailed drawings which have been prepared by the City Engineer, filed with the City Clerk, and which are hereby approved and adopted. . Section 5. All of the work necessary to be done in connection with the mak ing of said improvement shall be done and made by contract upon competitive bids; and th: City shall have the power to reject any and all bids. Section 6. There isl hereby created a special fund to be called "Local Im- provement Fund, District No. 805 " -, into which shall be placed all sums paid on account of the aforesaid special assessments, including all interest and penalties thereon; and, in the event of the sale of Local Improvement Bonds by the City, all premiums and inter- est on said bonds issued for said improvement. Section 7. Bonds bearing interest at the rate of 4 per cent per annum, pay able on or. before 12 years from the date of issuance, shall be issued in payment of the cost and expense of said improvement; which bonds shall be redeemed by the collection of special assessments to be levied and assessed upon the property within said district, payable in 10 equal annual installments, with interest at the rate of 4 per per annum, interest payable annually, under the mode of "Payment by Bonds" as defined by the -- statutes of the State of Washington, and the Ordinances of the City of Yakima. Section 8. This ordinance is one relating to local improvements or assess- ments therefor, and shall become effective immediately upon its passage, approval and _publication as provided by the City Charter.
