ORDINANCX NO. B -1679 .
AN ORDINANCE providing for the improvement of property in the City of Yakima, Washington .
by the construction of a domestic water system, establishing a local im-
provement district, providing for the method of payment therefor, and cre-
ating a special fund.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. That property in the City of Yakima, Washington, shall be im-
proved by the construction of a domestic water system, with the necessary mains, fire
hydrants, valves and other appurtenances for the purpose of supplying water for domestic
use; said improvements to serve the property the boundaries of which are described as
follows: .
The boundaries of the proposed district are described as follows:
Beginning at a point on the South line of Nob Hill Boulevard 142
feet East of 21st Avenue South; thence southerly and parallel with
21st Avenue South to Viola Avenue; thence westerly along Viola Avenue
to a point 142 feet west of 22nd Avenue South; thence northerly and
parallel with 22nd Avenue South to the center line of Prasch Avenue;
thence easterly along said center line to a point South of the south-
west corner of Lot 31 of French's Subdivision; thence northerly and
parallel with 21st Avenue South to the South line of Nob Hill Boulevard;
thence easterly along said South line to the point of beginning, in
Yakima County, Washington;
all of said improvements to be constructed in full accordance with the plans and speci-
fications to be prepared by the City Engineer.
Section 2. There is hereby created and established a Local Improvement
District to be called "Local Improvement District No. 804 which said district shall in-
clude all of the property described and set forth in Section 1 hereof.
Section 3. A portion of the cost and expense of said improvement, includ-
ing the cost of acquiring right of way easements, engineering, surveying, advertising,
inspection, publication of notices and other expenses incident thereto, the same being
estimated by the City Engineer to be approximately $6,136.72, shall be levied and asses
ed upon all of the property embraced within said Local Improvement District, in accord-
ance with the special benefits conferred thereon, in the manner provided by the Laws of
the State of Washington -and the Ordinances of the City of Yakima; and the City Water
Department shall pay the remainder of the cost and expense of said improvement, said
portion being estimated by the City Engineer to be approximately the sum of $4,488.04,
pursuant to segregation of said costs in accordance with Resolution No. C -1051, adopted
on March 30, 1953. .
Section 4. All of the work necessary to be done in connection with the mak
ing of said improvement shall be done by the City of Yakima.
Section 5. There is hereby created a special fund, to be called "Local Im-
provement Fund, District No. 804 ", into which shall be paid all sums paid on account of
the aforementioned special assessment, including all interests and penalties thereon;
and in the event of the sale of Local Improvement Bonds by the City, all premiums and
interest on said bonds issued for said improvement.
Section 6. Bonds bearing interest at the rate of 4% per annum, payable on
-or before 12 years from date of issuance, shall be issued in payment of the cost and ex-
pense of said improvement; which bonds shall be redeemed by the collection of special
assessments to be levied and assessed upon the property within said district, payable in
ten equal annual installments with interest at the rate of 4% per annum interest payable
annually, under the mode of "Payment by Bonds" as defined by the statutes of the State
of Washington and the ordinance of the City of Yakima.
Section 7. This ordinance is one relating to local improvements or assess-
ments therefor, and shall become effective immediately upon its passage, approval and
publication as provided by the City Charter.
PASSED BY THE CITY COMMISSION, signed and approved this 11th day of April,
1955.
