B -1676 AN ORDINANCE relating to and prescribing the amount of license fees for gaming devices of the nature generally known as "clocks "; defining offenses, prescribing penalties and declaring an emergency. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. It shall be unlawful for any bona fide legitimate lodge or club to own, maintain or operate any gaming device or amusement device of the nature generall known as "clocks" without first obtaining from the city clerk a license so to do and without first paying to the city a license fee in the sum of $100.00 for each device pay f able annually in advance on January 1, of each year, or for any p of year; P r vided, however, that the full annual amount thereof shall be payable during the year 195 and each year thereafter when such license is issued hereunder. • Section 2. It shall be unlawful for any person, firm, corporation, or association, except as specified in Section 1 hereof, to own, maintain, or operate any such device in any business establishment or for the purpose of profit. Section 3. Any person -who shall violate any of the provisions of this ordi nahce shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be fined in any sum not to exceed $300.00 or be imprisoned for a period not exceeding 90 days, or by both such fine and imprisonment. Section 4. If any section, part of a section, clause or sentence of this ordinance shall be held to be unconstitutional or invalid, such decision shall not aff ec' the validity of the remaining provisions of this ordinance. Section 5. This ordinance is one to provide for the immediate preservation of the public peace, property, health and safety, and an emergency is declared to exist, and this ordinance shall be in full force and effect immediately upon its passage, ap- proval and publication, as provided by law and the City Charter.
