B-1638 - AN ORDINANCE providing for the improvement of property in the City of Yakima, Washington, by the construction of a domestic'water system, establishing a local improve- - ment district, providing for the method of payment therefor, and creating a special fund. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. That property in the City of Yakima, Washington, shall be im- proved by the construction of a-domestic water system, with the necessary main, fire - hydrants, valves and other appurtenances for the purpose of supplying water for domestic use; said improvements to serve the property the boundaries of which are described as follows: ' Beginning at a point on the West line of the Southeast quarter of the_ Southeast quarter of the Southwest quarter of Section 30, Township 13 North, Range 19, E.W.M., a distance of 140 feet north of the north line of Mead Avenue; thence South along said West line and the West line of • Lot 1 of Phoebe D. Adams Subdivision to a point 140 feet South of the • "South line of Mead Avenue; thence Easterly and parallel with Mead Avenue to the Westerly line of the Union Pacific Railroad right -of -way; thence Northerly along said Westerly line to a point East of the point of begin- ning; thence Westerly to the point of beginning; . all of said improvements to be constructed in full accordance with the plans and specifi cations to be prepared by the City Engineer. Section 2. There is hereby created and established .a Local Improvement Dis- trict to be called. "Local Improvement District No. 796" which said district shall in- clude�all of the property described and set forth in Section 1 hereof. Section 3. All of the cost, and expense of said improvement, including the cost of acquiring right of way easements, engineering, surveying, advertising, inspectio , publication of notices and all other expenses incident thereto, shall be levied and assessed upon all of the property embraced within said Local Improvement District, in accordance with the special benefits conferred thereon; in the manner provided by the Laws of the State of Washington and the Ordinances of the City of Yakima; and said City shall not be liable in any manner for any portion of said costs and expenses of said im- provement. . • Section 4. All of the work necessary to be done in connection with the mak -. ing of said improvement shall be done by the City of Yakima. Section 5. There is hereby created a special fund, to be called "Local Im- provement Fund, District No. 796", into which shall be paid all sums paid on account of the aforementioned special assessment, including all interests and penalties thereon; an in the event of the sale of Local Improvement Bonds by the City, all premiums and inter- est on said bonds issued for said improvement. Section 6. Bonds bearing interest at the rate of 4% per annum, payable on or before 12•years from date of issuance, shall be issued in payment of the cost and ex- pense of said improvement; which bonds shall be redeemed by the collection of special assessments to be levied and assessed upon the property within said district, payable in ten equal annual installments, with interest at the rate of 4% per annum interest payabl= annually, under the mode of "Payment by bonds" as defined by the statutes of the State of Washington and the Ordinances of the City of Yakima. Section 7. This ordinance is one relating to local improvements or assess- ments therefor, and shall become effective immediately upon its passage, approval and publication as provided by, the City Charter.
