B -1637 R ENEALED EY ORDINANCE Noodd477 AN ORDINANCE relating to and prescribing the amount of license fees for Class "A" amuse- ment devices, including pinball machines, card tables, pool tables, and other gaming devices; defining offenses, prescribing penalties, and repeal- ing portions of certain ordinances inconsistent herewith. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The provisions of this ordinance shall be deemed an exercise of the power of the City of Yakima to license for revenue. Section 2. From and after January 1, 1955, it shall be unlawful for any person to own or operate in any business establishment or for the purpose of profit any of the following amusement devices without first obtaining from the City Clerk a license so to do and without first paying to the city a license fee payable annually in advance on January 1st of each year, or for any portion of a year, in the following respective amounts: . - . . a. Class "A" amusement devices, as defined in Ordinance No. B -1093 passed on January 17, 1950, including pinball machines:. $100.00 for each such machine or de- vice in any location; the same being payable by the owner or lessor of such machines or devices; and the same being in addition to the license fees prescribed in said Ordinance No. B -1093, . b. • Card tables: $300.00 for the first table, $200,00 for the second table, and 100.00 for each additional table; the same being based on the total number of tables in such location or establishment available for use (whether or not actually in use). c. Pool tables: $25.00 for the first table, and $10.00 for each addition- al table available for use (whether or not actually in use). d. Gaming devices of the nature generally known as "clocks "; $100.00 for each such device., . Section 3. Any person violating or failing to comply with any of the pro- visions of this ordinance, upon conviction, shall be deemed guilty of a misdemeanor and shall- be punished by a fine in any sum not exceeding $300.00 or by imprisonment in the _ city jail for a term not exceeding 90 days or both such fine and imprisonment. Section 4. Any portions of existing ordinances prescribing different license fees for such amusement devices, insofar as the same are inconsistent herewith, are hereby repealed; provided, however, that Ordinance No. .B1.093 shall remain in full force and effect. Section 5. This ordinance shall be in full force and effect thirty (30) days after its passage,.approval and publication, as provided by Law and the City Charter.
