B -1614 AN ORDINANCE amending Section 41 of the Traffic Code, Ordinance No. B -1526; prohibiting racing, speed trials, illegal cruising, nuisances, and unnecessary noise in the operation of motor vehicles. prescribing penalties, and declaring an emergency. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. Section 41 of the Traffic Code, being Ordinance No. B -1526, entitled "AN ORDINANCE relating to and regulating traffic, travel and transportation and their incidents upon the streets and other ways open to the public; prescribing the powers and duties of officers and others in relation thereto; defining offenses; pro - viding penalties, and repealing Ordinance No. 13-131 and all amendments thereof and all other ordinances in so far'as they are in conflict therewith, and declaring an emergency', passed on December 31, 1953, is hereby amended to read as follows: - "Section 41. Speed trials, Cruising, and Unnecessary Noise Unlawful.. (a) It shall be unlawful to .engage in, conduct, manage, or instigate any race, speed trial, or speed contest upon the streets. Any person or persons guilty of comparing or contesting relative speeds by simultaneous operations shall be guilty of reckless driving, whether or not such speed is in excess of maximum speed prescribed by law. (b) It shall be- unlawful to cruise, drive or operate any motor vehicle, • - other than an official police vehicle, repeatedly - or persistently to and fro upon Yakima Avenue or any other public street for an excessive, unnecessary or unreasonable length of time. (c) It shall be unlawful to operate any vehicle in such a manner as to .cause any unnecessary or unreasonable loud noise, whether due to sudden starting, sudden stopping, exhaust explosion, lack of proper muffler, or otherwise, of such a nature as to be, cause or create a nuisance or so as to be substantially disturbing, annoying or offensive to other persons. (d) It shall be unlawful to operate a vehicle in such a manner as to dis- turb, disrupt, impede or harass the normal, lawful flow of traffic on any street, or other vehicle operators, users of the streets, or pedestrians. (e) It shall be unlawful for any person to communicate or talk back and forth from a moving vehicle to a person or persons in another moving vehicle on any street in any unnecessary or unreasonable manner or for any unnecessary or unreasonable length of time." Section:.2, Any person who shall violate or fail to comply with any provision of this ordinance or who shall counsel, aid or abet any such, violation or failure to comply shall be deemed guilty of a misdemeanor, and upon conviction thereof, shall be punished by a fine in any sum not exceeding three hundred dollars ($300.00) or by imprisonment in the city jail for a term not exceeding ninety (90) days, or both such fine and imprison- ment. Section 3. If any provision of this ordinance or the application thereof t• any person or circumstances is for any reason held invalid or unconstitutional, the re- mainder of this ordinance and the application of such provisions to other persons or circumstances shall not be affected thereby. Section 4. This ordinance is -one to provide for the immediate preservation of the public peace, property, health and safety, and an emergency is declared to exist, and this ordinance shall be in full force and effect immediately upon its passage, ap- proval and publication as provided by law and the City Charter.
