L Z1' ORDINANCE NO. .B -1627 AN ORDINANCE providing for the acquisition by condemnation proceedings or purchase of real property for the enlargement and improvement of the Yakima Municipal Airport, providing for the method of payment therefor, and declaring an emergency. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. That it is necessary that the City of Yakima, Washington, acquire title by condemnation proceedings or purchase to the following described real property situate in Yakima County, Washington, to -wit: • Beginning at the Northwest corner of the Northwest quarter of the Southeast quarter of Section 34, Township 13 North, Range 18, E.W.M.; thence Easterly along the North line of said sub- division 1,320 feet more or less to the Northeast corner of the Northwest quarter of the Southeast quarter of Section 34, Township 13 North, Range 18, E.W.M.; thence Southerly along thee Easterly line of said subdivision 511.03 feet, thence North 70 03 1,402.4 feet, more or less to the Westerly line of'said subdivision, thence Northerly along the Westerly line of said subdivision 37.1 feet more or less to the point of beginning, together with all water rights and appurtenances thereunto belonging, being approxi- mately 6.6 acres. A tract of land in the Northeast quarter of the Southwest quarter of the Southwest quarter, and the Northwest quarter of the South- east quarter of the Southwest quarter, of Section 35, Township North, Range 18, E.W.M., described as follows: Beginning at a point on the North line of the Southwest quarter of the Southwest quarter of said Section 35, 300 feet West of the Northeast corner of said subdivision; thence South 70 ° 03 1 East a distance of 740 feet more or less to the northwesterly property line of the Northeast /Southwest runway of the Municipal Airport; thence Northeasterly along said property line to a point on the East line of the Northwest quarter of the Southeast quarter of the Southwest quarter of said Section 35, said point being 87 feet South of the Northeast corner of the subdivision; thence North 87 feet; thence Westerly along the North line of the Northwest quarter of the Southeast quarter of the Southwest quarter and of the Northeast quarter of the Southwest quarter of the Southwest quarter to the point of beginning, together with all water rights and appurtenances thereunto belonging, being approximately 3.03 acres. . Beginning at the Southwest corner of the Northeast quarter of the Southeast quarter of Section 34, Township 13 North, Range 18, E.W. M.; thence South 89 ° 54 1 East 662 feet; thence North 0 ° 13 1 East 665.7 Feet to the true point of beginning; thence South 0 ° 13 1 West 86 feet; thence North 70 West approximately 2 5 4 .5 feet, more or less to the intersection with the north line of the Southwest quarter of the Northeast quarter of the Southeast quarter of said Section 34; thence Easterly along said North line 239.5 feet, more or less, to the point of true beginning, together being approximately and appurtenances thereunto belonging, g pp loxi y h acre. Beginning at the Southwest corner of the Southeast quarter of the Northwest quarter of Section 35, Township 13 North, Range 18, .E.W.M.; thence Northerly along the West line of said Southeast quarter of the Northwest quarter 275 feet; thence South 70 0 03' East 709.1 feet, more or less, to the East line of the West half of the Southeast quarter of the Northwest quarter,of -said Section 35; thence Southerly along said East line a distance of 35.38 feet, more or less, to the South line of said Southeast quarter of Northwest quarter; thence Westerly along said South line a distance of 667.38 feet, more or less, to the point of beginning, together with all water rights and appurtenances thereunto belonging, containing approximately 2.38 acres. Beginning at the Southwest corner of the Southwest North, of S the Northwest quarter of Section 35, Township 13 a a Range 18, E.W.M.; thence South 89 ° 48' East 677.5 feet; thence Northerly along the East line of the West half of the Southwest quarter of the Northwest quarter of said Section 35, 416.07 feet; thence j North 70 °03' West, 718.69 feet, more or less, to a junction with the West line of said Section 35; thence Southerly along said West line of Section 35, 659.3 feet, more or less to the point of beginning, except therefrom the North 99 feet of the South 228 feet of the West 145 feet of the East 165 feet of the East half of the West half of the Southwest quarter of the Northwest quarter, containing approximately 7..92 acres, together with all water rights and appurtenances thereunto belonging. The North 99 feet of the South 228 feet of the West 145 feet of the East 165 feet of the East half of the West half of the Township Southwest quarter of the Northwest quarter of Section 35, p 13 North, Range 18, E.W.M., together with all water rights and appurtenances thereunto belonging, containing approximately .32 acres. for the purpose of enlarging and improving the Yakima Municipal Airport, the same being an airport owned and operated by said City; and it is hereby ordained that title to said real property hereinabove described be acquired by condemnation proceedings or purchase as provided by law for the acquisition of property for such public use. 9 ORDINANCE, NO. B -1627 • Section 2. That the cost and expense of acquisition of.said real property shall be determined in the manner provided by law; and all of such cost and the payment of just compensation therefor, and for any severance damage done to adjoining property by the acquisition of said real property, as determined by any proceedings for such acqui- sition, shall be paid from any general funds of the city applicable thereto. Section 3. This ordinance is one to provide for the immediate preservation of the public peace, property, health and safety, and an emergency is declared to exist, and this ordinance shall be in full force and effect immediately upon its passage, ap- proval and publication as provided by and the City Charter. .� ` 3 PASSED BY THE CITY COMMISSION, signed and approved this 1st day of December, 1954. .
