ORDINANCE NO. B -1616
AN ORDINANCE providing for the improvement of certain property by grading, ballasting,
surfacing and constructing concrete curbs and gutters; establishing a local
improvement district, providing for the method of payment therefor, and
• creating a special fund.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. That 17th Avenue South from Nob Hill Boulevard to West Prasch
shall be improved by grading, ballasting, surfacing, and constructing concrete curbs
and gutters; all of said improvements to be constructed in full accordance with the
plans and specifications prepared by the City Engineer and filed with the City Clerk.
• The property to be benefited by this improvement consists of the following:
•
Beginning at a point on the south line of Nob Hill Boulevard midway between
16th Avenue South and 17th Avenue South; thence Southerly and parallel with
17th_Avenue South to West Prasch Avenue; thence Westerly along West Prasch
Avenue to a point 139 feet West of the West line of ,17th Avenue South;
thence Northerly and parallel with 17th Avenue .South to the South line of
the point of beginning, and situate in the City of Yakima, Yakima County,
Washington.
Section 2. There is hereby created a Local Improvement District to be
called Local Improvement District No. 79 which said district shall include all of the
property described., and set forth in Section 1 ' hereof. .
Section 3. All of the costs and expenses in connection with the making and
construction of said improvement, including the cost and expense of engineering, inspec-
tion, advertising, publication of notices and all other expenses incident thereto, shall
• be levied and assessed. upon all of the.property embraced within said Local Improvement
District in accordance with the special benefits conferred thereon, in the manner and
as provided by laws of the State of Washington and the ordinances of the City of Yakima,
and said City shall not be liable in any manner for any portion of said costs and ex-
penses of said improvement. .
Section 4.' All of the aforesaid construction work shall be in accordance
with the plans, specifications, profiles, maps and detailed drawings which have been
prepared by the City Engineer, filed with the City Clerk, and which are hereby approved
and adopted.
Section 5. All of the work necessary to be done in connection with the
making of said improvement shall be done and made by contract upon competitive bids; and
the City shall have the power to reject any and all bids. .
Section 6. There is hereby created a special fund. to be called "Local Im-
provement Fund, District No. 79 into which shall be placed all sums paid on account
of the aforesaid epecial assessments, including all interest and penalties thereon; and,
in the event of the sale of Local Improvement Bonds by the City,, all premiums and int-
erest on said bonds issued for said.improvement.
Section 7. ,Bonds bearing interest at the rate of 4 per cent per annum, pay
able on or before 12 years from the date of issuance, shall be issued in payment of the •
cost and expense of said improvement; which bonds shall be redeemed by the collection of
special assessments to be levied and assessed upon the property within said district,
payable in 10 equal annual installments, with interest at the rate of 4% per annum, int-
erest payable annually, der the mode of "Payment by Bonds" as defined by the :s'tatutes
of the State of Washingtfd the Ordinances of the City of Yakima.
Section 8. This ordinance is one relating to local improvement or assess-
_ ments therefor, and shall become effective immediately upon its passage, approval; and
publication as provided by the,City Charter.
